This is truly surreal. It'd been mentioned already, but we had this cow crossover. Ethan just so happened to get video of Chris being arrested (the likelihood of that is rather cosmic) and they're both being held partly accountable for their unrelated crimes around the same time. What if they both went to prison around the same time too? At that point, I'd have to wonder who's writing the script.
Apropos of nothing, did you know that mushrooms' mycelial network can communicate over long distances and different parts can work together to chemically alter its own environment, even intentionally allowing or disallowing local species to survive?

What We Don't Know

1.) Why was the case nolle prosequi'd instead of being dismissed outright? Until someone is able to get the paperwork from the court--if this is possible--we don't know. A nolle prosequi (noll pros) is the prosecution making a motion to state they are not pursuing the case any further than it already has but they are also not dismissing the case. This allows the prosecutors to continue later on with the charges should there be an issue, such as new evidence coming to light. A dismissal would include attaching double jeopardy, which would mean that he could not be charged for the same crime again; however, a noll pros allows for the prosecution to refile the charges at a later time, the length of which is determined by statute.
Point of clarification here: a successful nolle pros motion does effect a dismissal. VA Code §§ 19.2-265.3; 19.2-265.6. "Nolle prosequi" refers (basically) to a motion by the prosecution, and "dismissed" refers to the case disposition once the motion is granted. If done before jeopardy attaches, a nolle prosequi motion effects a dismissal without prejudice. In fact, a dismissal for almost any reason short of acquittal / insufficiency of evidence is a dismissal without prejudice. § 19.2-265.6(B). A notable exception here is that, in VA (but not everywhere), jeopardy generally attaches to a final guilty plea. Peterson v. Commonwealth, 5 Va. App. 389, 395 (Va. Ct. App. 1987) (“Where there is no trial at all, but rather a plea of guilty, . . . jeopardy attaches when the court accepts the defendant's plea," and reprosecution is barred "absent special circumstances” such as an express written waiver). But that exception does not apply to Ralph, as he did not plead guilty.

So the question you’re asking is "why was the case dismissed without prejudice instead of with prejudice?" The short answer is because jeopardy never attached, and apparently Ralph's deal did not include a term specifying that the dismissal was with prejudice. § 19.2-265.6(B). Ralph is not Hillary Clinton, so it us unlikely such a deal would ever be offered to him outright.
2.) Why was the case brought back to the fore? Thinking right now is the noll pros had a stipulation attached, namely to leave the Vickers alone and to sever all ties to them. However, we know that on July 8/July 9 Ethan messaged/texted Mr. Vickers, threatening him because he allegedly took away Faith's internet access because she was in communication with Ralph. he even ran to Twitter to brag about doing it. You can read that saga here. He also insinuated Vickers was a pedophile and that Xander would not be safe around him. Not long after, Mr. Vickers filed for a restraining order against Ralph.
Ralph's behavior toward the "victim" has been pretty egregious. There are many things that could have irked the prosecutor here, particularly the threats. Did Ralph violate a term of his deal? Did Vickers ask a higher-up to review the case? Did the case simply get reassigned to a different prosecutor? It's all speculation for now.

It's worth noting though that Ralph inserted himself into the Chris Chan controversy, which has generated mainstream media attention, and is in the same vicinity as Ralph's legal troubles. Ralph is already looked upon with disfavor in the media. But imagine how Colette Wallace McEachin would feel sitting for re-election in November of this year, as her opponent rails against her for nolle prossing the fat, contemptible, N-slur-uttering pig who (1) released revenge porn of his pregnant ex-girlfriend, then (2) went on to exploit an autistic mom-raping manchild for internet views. She's better off making an example of him.
4.) Will Ralph see jail? Unknown at this time. The charge is a misdemeanor carrying a maximum penalty of 12 months in jail (not prison) and/or a $2,500 fine for the first offense. THERE IS NO WAY HE'S ENDING UP ON THE SEX OFFENDER REGISTRY. My expectation is some time of probation and a fine, and possibly community service. However, Virginia does take into account prior convictions and actions by the defendants in determining the punishment, and with Adezero's restraining order against him that might figure into it, alongside his assaulting a female cop.
There's pretty much no way he's going to jail for a misdemeanor first offense under the charged section.

I wonder if Covid could of had something to do with it, perhaps due to this being a misdemeanour they opted to delay it and concentrate on more important cases whilst things had slowed down due to Covid?

Again speculation on my part, but could this be a possibility? If so, it would make it all the more funny that Ralph tried to spin this as him being exonerated.
 
.Jail seems extreme here even with the prior felony. How often do people end up in jail over a class 1 misdemeanor?
Ralph managed to turnfalling asleep drunk in a hotel lobby into a prison sentence. Don't underestimate his ability to always double downon making things worse. He can probably convert a misdemeanor onto Death Row.

Jail would be a good slap in the face for Ethan Ralph. He needs to spend a few years getting sober and fucked in the ass to put things back in perspective.
