The baby from Nirvana's famous "Nevermind" album art is all grown up ... and now he's suing the band for child sexual exploitation.

A man named Spencer Elden claims he's the naked baby famously pictured in a swimming pool on Nirvana's groundbreaking 1991 album cover ... and he's suing the band, its surviving members and Kurt Cobain's estate, 30 years after the album dropped.

According to a new federal lawsuit, obtained by TMZ, Elden claims he could not consent to his image being used on the album art way back in the day, because he was only a 4-month-old baby ... and says his legal guardians didn’t consent to it either.


Elden's going even further ... in his suit, he claims the image is actually child pornography. He also claims the band made a promise to cover his genitals with a sticker but it was never incorporated on the album cover.

According to the docs, Elden claims Kurt, Dave Grohl and the rest of the band failed to protect and prevent him from being sexually exploited ... and he says having his naked baby body plastered on a famous album caused him to suffer lifelong damages.

Elden's going after the band, Kurt's estate and others for damages ... and he wants them to each cough up at least $150,000.

We reached out to reps for Nirvana and Kurt's estate ... so far, no word back.

Nirvana already had a photo like the one they ended up using. The reason they didn't keep it was because the photographer wanted a lot of money for it plus yearly royalties.
The band told him to fuck off and looked elsewhere and eventually found the kid's dad.
His father was a photographer who agreed to take the picture for Cobain for cheaper and sell it to him in a one-time payment.

Cobain had a fight with the record suits because the suits didn't want the baby penis to be showcased as they thought people would cite this as pedophilia.
The entire band thought this was ridiculous but agreed to a compromise; either the photo is kept as is, or the sticker covering the baby wang would have to include a caption that more or less said: "If you think this counts as sexual material, you're probably a closet pedophile".
The suits folded and the album art was released as is.

Again, the kid has been fine with this for years and the band has sent him memorabilia as well. He has been on record stating that he loved the fact he was immortalized in an iconic album cover. What changed? Does he want a new car for free or something?

I wonder what the band thinks of the model of their cover being a closet pedophile...

According to Aftonbladet, a SCORPIONS album advertisement classified as child pornography ran for 24 hours on Tradera, popular online marketplace and classifieds site from Sweden, before being removed.


Back in 2015, a Swedish court ruled that an image of a naked girl on the SCORPIONS' 1976 album "Virgin Killer" found at the home of a 53-year-old pedophile's home could be considered pornographic material.


On Friday, an ad appeared for a copy of the album on Tradera. In the announcement, the seller pointed out that it was an uncensored copy of the original album cover.


Ten offers were made to purchase the LP, including one for 352 Swedish kronor (approximately $40), before the ad was pulled. Now the advertiser is at risk of being reported to the police.


"We will take a closer look at the specific case," Tradera's head of security, Niclas Hjelm, told Aftonbladet. "This is an album that shows up [on Tradera] from time to time and that we shut down as soon as ads for it are noticed."


Asked if Tradera will contact the police over the incident, Hjelm said: "If it is a question of suspected violations of the law and not just violations of our policy, we make our reports to the police."


SCORPIONS guitarist Rudolf Schenker told Blasting Zone in a 2007 interview that the original "Virgin Killer" cover was the record company's idea. "The record company guys were like, 'Even if we have to go to jail, there's no question that we'll release that,'" he said. Explaining the original idea behind the album title, Rudolf said: "On the song 'Virgin Killer', time is the virgin killer. But then, when we had to do the interviews about it, we said 'Look, listen to the lyrics and then you'll know what we're talking about. We're using this only to get attention. That's what we do.' Even the girl, when we met her fifteen years later, had no problem with the cover.'


He added: "Growing up in Europe, sexuality — of course not with children — was very normal. The lyrics really say it all. Time is the virgin killer. A kid comes into the world very naïve, they lose that naiveness and then go into this life losing all of this getting into trouble. That was the basic idea about all of it."


A year earlier, former SCORPIONS guitarist Uli Jon Roth also blamed the band's record label for the original "Virgin Killer" cover, telling Classic Rock Revisited: "Looking at that picture today makes me cringe. It was done in the worst possible taste. Back then I was too immature to see that. Shame on me — I should have done everything in my power to stop it."

Attempting to sell the album with the original uncensored cover could get you a visit from the police. At least in Sweden. Which is rather odd considering their rampant rapefuee problems. Might want to put the coppers on that one first.

Oddly enough the album cover is on Wikipedia. The ten year old girl in the photo is a relative of the cover's designer. I don't think she's ever come forward to sue. The band acknowledges that it was in poor taste and that they were too immature to see it back then. The song isn't about raping or murdering children. But I can see why anyone could look at the cover, the title and think that. Some people have suggested they should have just used a clock because of the lyric "Time is the virgin killer".

Led Zeppelin's "Houses of The Holy" also features nude children. That cover, featuring young siblings climbing Giant's Causeway, also caused controversy and the album was wrapped in paper to obscure the image.

And I'm probably on some kind of fed list now for researching this information.

Anyway, if he Spencer Elden was ok with it all these years it looks suspect. His parents saying they didn't consent to the nude photo being used even though they did is also suspect. Either they don't want the kid to sue them too or everyone's looking forward to a threeway payday. Lots of luck prying any of Kurt's money out of Courtney's trackmark ridden hands. You messed with the wrong succubus, kid.

People take photos of their babies all of the time. Can they sue, too?

Imagine suing mom because she took a pic of you in the bathtub when you were two. I can't see stuff like this working out unless the photo was taken by some pedo/uploaded to a pedo site.

Unless you have what it takes to be legendary you better enjoy it while you can. Because your music is just a bump in the road to the suits.

Wasn't this all the same shit Sonic Youth and possibly Flipper! had been doing since 1979 or so? (I think even down to the whole flannel shtick.) This sort of music has never been my cup of tea so maybe I'm wrong.

The other day I mentioned Bow Wow Wow's album cover from 1981. Interestingly the then 14 year old's mother tried to get it banned, but failed.

He’s based his entire existence on the cover and the Nirvana money isn’t there and no one cares about the baby on the cover of one album, so this is his last desperate attempt to extract money from them.
It’d fail the child porn test, nudity on its own isn’t enough to qualify outside of other factors, he’s done countless interviews about how happy he is to be on the cover (no one would even know who it was if he didn’t keep promoting himself as the Nirvana baby), and the contract for it has been discussed in previous interviews, so that’s going to fail too.
At best maybe he could milk some fools with a gofundme but even on Twitter everyone thinks he’s a moron.

I doubt Kurt even bothered singing the correct lyrics when singing it live. The song is tailor made for bullshitting.

Always found the album cover for Nevermind creepy. Same goes for Scorpions' Virgin Killer.

Grohl seems like a pretty decent dude, and even though all the Foo Fighter songs are basically the same tune, I dig some of them. Their cover of Numan's "Down in the Park" is actually pretty decent in my opinion.

Not sure what the hate for him's about here. And this dude suing, given he 'recreated' the pose for multiple anniversaries, has the tat and all that, would seem to really cement the money grub of it all. If it hasn't grown since the picture, maybe he should cut it off; we all need something new to watch with the current season of Chris-Chan on hiatus until September.

If... if the picture is so traumatic and child porn-ey, does he fucking realize that he could just...IDK...NOT MENTION the picture? Like, it's an infant! He could be in the same room crowded with other people and that album and NO ONE WOULD KNOW if he didn't fucking mention it.
