With a clear, unequivocal ruling the states can just point to it and say that the new one is so obviously unenforceable they'll just ignore it. Hell, the states can be ignored here too and anyone pushing for it in a court can just point to it and be done.

This already happened, in fact. Tennessee said Kavanaugh merely signaling it was unconstitutional was enough for the entire state to ignore it. And that was before we got an official ruling.

Something more important here, it would be an Executive Order issue. EO's do not create a new policy, they only determine how current policy should be executed. With the whole thing labeled as an overreach, there is no way to reword it. Not even a veneer of acceptability. By forcing SCOTUS' hand, they set up a situation where anyone in court can point to a SCOTUS ruling directly and say "The Federal Government should not be acknowledged as having power".

Maybe late, but if you remember how Biden's first week in office involved an airstrike on a Syrian checkpoint on the border of Syria and Iraq... Well, that strike killed 23 people, who were later confirmed to be unarmed men women and children, rather than militants.

I've got to disagree on this one. Sure, the left leaning press carried his water, and almost deified the guy... but I think the standards have fallen further even since then. Yes, perhaps they'd try to soften the blow, but even though, for instance, there are some at CNN (and other sources) that have been critical, they still are not challenging him when he speaks to the press. I believe a great deal of it has to do with the fact that he's not in full control of his mental faculties, they know it, and they are trying not to expose that any further than what Biden does himself, simply by showing up. If they laid it bare...naked for all to see, I think, perhaps, some hard questions would be headed in their direction for covering up for what is pretty obviously a man suffering from sort of cognitive disability. On the other hand Obama had no such issue, although he's not nearly as intelligent as the press made him out to be. In this case, because of that alone, he (Obama) would be grilled a bit tougher than Biden's been,,, and not allowed to simply refuse to talk about it. Truth be told, I think The Obama administration would at least put up some sort of front to at least attempt to look like they are taking some accountability for this sort of massive screwup. And again, the left leaning press' (and the press in general) standards have declined even further since 2008-2016.
