Maybe pie in the sky, but it might be a good thing whether it's granted or not. Melinda's appeal is already approved, which imo is one step closer to that vexatious litigant label if once again a higher court has to read her nonsense claims when the previous ruling made it pretty clear the judge was fed up with her shit.

Source? District court certainly didn't grant it yet, and neither did the appeals court. Her last approved appeal was in 2019. Hell, her notice of appeal isn't even on the docket for the district court yet, and we wouldn't have known about her wishes for appeal yet if not for Mr. Hardin

When stuff like that happens you KNOW the eye of Sauron is looking right at you. A smart person would realize this but as has been well established Melinda is not a smart person. She is the opposite of smart. She is very stupid. And fat.
 
I'm optimistic. The judge clearly understands that Mel likes to file frivolous motions, and he made that clear in his final order. Mel also pissed him off somewhat. So, yeah, I'm somewhat optimistic.
Same here, I'm cautiously optimistic... I'd say this has a 20-25% chance of being granted, that way if it happens I'll be pleasantly surprised.
 
Can a legal kiwi please soothe my ignorance? Getting something like a court ordered psych-eval would be completely off the table, wouldn't it? Since you're already asking for payment, in my legal ignorance it occurs to me that you might also posit the idea that she clearly has some brain troubles. Sure she's a real obnoxious piece of shit but you can't help but feel bad for her (not really ofc), you'd like to see some relief to her greater obstacles in life. None of this would be a bad thing. You know she'd absolutely hate it which means it'd probably be really good for her.

I'm almost certain the answer is no, just making sure.

For one, there's no reason for Hardin to even request such a thing, and I don't recon Null would like to pay Hardin for such a request. Secondly, this is not the type of case in which such evaluations are common.

It's highly unlikely such evaluation would be requested, and I figure even more unlikely for it to be accepted.

Not a legal expert but practice shows that people making much wilder claims (Pam and Russ suing various celebrities and accusing those celebrities of really terrible things) went without such evaluation.

The one thing that may give Null and edge and force the Judge to require an appeal bond is that she has already brought what is unquestionably this same manner to SCOTUS and been rejected. No clearly does not mean No to Melinda.

The Judge did order a psych exam for anti video game crusader lawyer Jack Thompson back in the day. But that may have been in part due to him being a lawyer. And being his own lawyer. I think the judge wanted the exam before he would accept any further filings from Jack. But there was also a state bar investigation involved so I'm not sure how much that played into the Judges ability to demand a psych eval? Jack in his throws of religious righteousness had been sending the Judge tons of gay porn.
 
A psych eval is something that'll typically happen in criminal cases where the government wants to establish the accused's mens rea ("criminal intent," either as a necessary element of the crime itself or if they think it'll be a significant sentencing factor if and when the defendant is convicted) or determine whether they're mentally competent to stand trial.

It could also be something that the government prosecutor would request (but not court ordered) as part of a plea deal (settlement arrangement) if the circumstances warranted it. That would be up to the prosecutor and defendant to both agree to the settlement, perhaps along with a guilty plea on some of the charges, in exchange for the prosecutor dropping certain other charges and/or recommending leniency in sentencing (downward departure from the sentencing guidelines). If it's a settlement then it will eventually become court ordered if the court signs off on it and orders the parties to carry out their respective sides of their agreement, but both parties have voluntarily entered into the agreement by then.

I guess nothing really prevents someone in a civil suit from trying to get a psych eval into the settlement agreement, but the other party probably isn't going to agree to it. And depending on the circumstances, the court might even find such a settlement unreasonable and refuse to order it.
 
He also submitted it to the court as "proof" that this other lawyer was trying to sell gay porn to underage children. Of course, submitting such images then became publicly available to anyone of any age. (they were submitted as court documents).

That was quick. I for one can’t wait to see the response. Melinda seems incapable of reading the mood in the Judges Courtroom and can’t seem to detect the rising whisks of steam radiating off the Judge. I mean surely she’ll get a different answer if she just says the same thing again. Nick is right, she’s addicted to litigation.

She's generally bad at reading people and, what's even worse, sees most interpersonal interactions as conflicts to be won by any means. I believe that in her mind the judge isn't a neutral party who's role is to determine the truth but another "enemy" to be defeated or outsmarted.
So of course the judge will lose his patience at some point and I think we're very close to this point.
