Important Notice to Amazon Prime Members You May Be Entitled to Compensation from a Court-Ordered Settlement.
President Trump’s Federal Trade Commission (FTC) has reached a settlement with Amazon.com, Inc. regarding allegations that Amazon violated the Restore Online Shoppers’ Confidence Act in connection with Amazon Prime. Amazon settled the case without admitting liability.
About the Case:
On September 25, 2025, the U.S. District Court for the Western District of Washington entered a $2.5 billion settlement reached by President Trump’s FTC in the action titled, Federal Trade Commission v. Amazon.com, Inc., et al., Case No. 2:23-cv-00932-JHC.
The FTC alleged that Amazon
Obtained consumers’ billing information before clearly and conspicuously disclosing material terms for Amazon Prime.
Failed to obtain consumers’ express informed consent for Amazon Prime.
Failed to provide simple mechanisms for consumers to cancel Amazon Prime.
Amazon defended the case and did not admit liability in the settlement.
Eligibility and Process to Receive Payments
Under the settlement reached by President Trump’s FTC, refund payments to eligible consumers that subscribed to Amazon Prime will be paid in two groups: (1) the Automatic Payment Group and (2) the Claim Process Payment Group.
Automatic Payment Group
You are eligible for an Automatic Payment if:
1. You are a U.S. consumer who signed up for Prime between June 23, 2019 and June 23, 2025, and
2. You enrolled through a Challenged Enrollment Flow, and
3. You used no more than three Prime benefits in a 12-month period from June 23, 2019 and June 23, 2025.
Consumers within this group do not need to take any action to demonstrate their eligibility. Amazon is automatically sending payments to all eligible consumers. Consumers receiving Automatic Payments will be given compensation for Prime membership fees paid during the applicable timeframe up to $51. Automatic Payments are being distributed within 90 days of the court order (by December 24, 2025).
Claims Process Payment Group
The window for filing claims for compensation under the settlement reached by President Trump’s FTC opens on January 5, 2026. If you are eligible, you will receive notice by email and/or post-card by early Febuary. You are eligible for a Claims Process Payment if:
1. You are a U.S. consumer who signed up for Prime, and
2. You unintentionally enrolled in a Prime membership through a challenged enrollment method at issue in the FTC’s lawsuit from June 23, 2019 - June 23, 2025; or you tried to cancel your Prime membership through the online cancellation process from June 23, 2019 - June 23, 2025, but were unable to do so; and
3. You used less than ten Prime benefits (e.g., delivery, shopping, streaming, reading, and other benefits provided to Prime members) during any 12-month period of enrollment in Prime, and
4. You did not receive an automatic payment as part of this Settlement already.
For consumers not eligible for an automatic payment, you may be eligible to submit a claim for payment. If you are eligible to submit a claim, you will receive a notice either by email or in the mail. The notice will provide instructions on how to submit a claim.
To be eligible to receive a Claims Process Payment, you will need to check a box on the claim form if one of the following two categories applies to you: you either (1) unintentionally enrolled in Prime or (2) tried to cancel through the online cancellation flow but were unable to do so. After the claim form is submitted, it will be reviewed for eligibility. Consumers whose claim form is approved will be provided compensation for Prime membership fees paid during the applicable timeframe up to $51.
