Nick Bate's trial begins on Tuesday the 19th January in four days time and after the last thread was locked due to constant shitposting and over A-Logging of Nick I thought I would create this thread for us to talk about the trial from Tuesday onwards and to see over the weekend if there's anybody actually planning on attending.

The last thread was justifiably locked and I think it's important to point out that absolutely everybody on here knows how vile Nick is and doesn't wish him well in the slightest. Therefore going on about how awful Nick is and how much you'd like him to die is a moot point that adds nothing to the conversation, this is not the place to discuss all the awful deaths you could imagine him suffering while inside.

Apologies if this has been posted too early or isn't informative enough. I just thought if a new thread was to be created that it would be best having one during the weekend before the trial. A great FAQ offering general information about Nick, what led to his arrest and the possible jail time he can face at the end of the trial can be found underneath:


Edit- Predictions like KatsuKitty made would also be fun, it'd be interesting to see how his actual sentence ends up correlating with what we think it'll be.

Thanks for starting this thread @Karen Riley Here is a link to the docket.

Now, I note with interest that there was an Order entered on Dec 28th with respect to allowing out of court statements under the Tender Years Hearsay Exception rule (sorry, Canadian lawfag here, @AnOminous can explain it).

The Commonwealth petitioned to enter these statements, and the Order is either allowing or denying the State to enter them. It would be nice to get a copy of the ruling on that! Could have major impact. It would also list what was sought to be entered most likely.

I may call the Court Monday and see what I can find out as to contents of the Order. I will post if I find anything out.

Nick's basically screwed. I'm predicting 8 to 15 years, lifetime sex offender registration, and by extension, homelessness after he gets out.
I honestly don't think he'll make it past 6 years due to his teeth. If he complains and gets over his fear of the dentist he might make it out, but just from the state of his mouth I think a potentially fatal infection, or something related, will do him in.

As much as I'd like for him to never get out of jail, I think this is the most likely option. The second one being "murder by cellmate after finding out he's a pedo".

I don't think Nick will be murdered, but depending on how he's placed at Lancaster Prison, he may end up severely injured. And that's just because he's an autist who can't shut up about how poop gets him hard.

We've all heard the story of how a man got killed after bragging about his sex crimes down the whole block, and another inmate throwing the sink through his door just to get a crack at killing the guy.
 
If Nick goes to prison, he will mostly die there or kill himself. He will be a convicted molester at best, child rapist at worst. Of his half-sister.

He also has his "interests" which the other Gen Pop won't like. Therefore, Nick will not survive in Gen Pop due to those factors.

If lucky, he wiill be placed in SC or Seg. If he is put in there, he will die of loneliness or figure out how to kill himself. Remember he also has social anxiety and whatever else. Locked in a room for 23 hours with nothing to do. This is what I hope happens to him personally.

The other option is he ends up in a psych hospital or something. And of course god forbid if he is found innocent.
 
As an aside, I'm pretty sure we all want Nick to go to prison but the almost fetishistic wishes about him getting the flesh shank in prison made the previous threads cluttery so I hope y'alls understand to keep that to reasonable limits to keep it easy to follow for actual updates.
 
What is the "Tender Years Hearsay" rule? I googled this but can't find a layman's explanation.

I just found this from PA Courts.

Its an appeal but my read of first 3 sentences seems to be that it means as the victim is in "tender years" is she competent enough to testify prior to admission of her out of court statements.

As the State made the motion, then it means the Order was granted. The State would not make a motion like that if they thought they would lose.

So, the victim will mostly like be competent to testify thus the stuff, at least some, will be admitted.

I assume it is not about Nick himself being competent as that would have to be made under a mental competency act or something, not a youth act.

My Canadian take.

The "ruling" from the above decision:

In sum, we hold that a finding of a child’s competency under Pa.R.E. 601 is not a prerequisite to the admission of hearsay statements under the TYHA. Additionally, we find no error by the trial court in concluding the victim was unavailable as a witness. Finally, we hold that the Superior Court erred in finding erroneous the trial court’s determination that the time, content, and circumstances of the victim’s statements provided sufficient indicia of reliability. Accordingly, the Superior Court erred in [J-143-2012] - 23 determining the trial court abused its discretion in admitting the victim’s out-of-court statements into evidence pursuant to the TYHA. However, as Appellee raised additional issues in his appeal to the Superior Court, which the Superior Court did not address as a result of its determination that the victim’s competency was a prerequisite to the admission of her out-of-court statements, we remand the matter to the Superior Court for consideration of Appellee’s remaining issues. Order reversed. Case remanded.

If I could have one wish, it'd be that Bate would be locked in for 24 hours a day. But we all know that'll never happen (because laws and shit).
