I think this could go either way. Dave has previously exaggerated his health, particularly his cardiac health. However he's a fat, hypertensive histrionic who isn't getting any younger, so he could have hissy-fitted himself into demand ischemia, probably on camera. Maybe Dave takotsubo'd from all the harassment and stalking and being homeless in a nice apartment; that'd be gender-affirming as heck.

When Dave was arrested for paraphernalia and distribution, was it confirmed meth or was that an educated guess?
I checked the Columbia police reports, but nothing jumped out at me. Rather than stealing something physical from the house, is it possible he was siphoning money out of their bank account(s)? I would assume this could account for both the theft itself and harassment, assuming the two are related. Of course,, I love the idea of Dave and his bad back trying to bust into the Muscato home (a la Strangers with Candy: "I stole the TV!")
The address listed is his parents house. He did join some "abuse" victims program where he has info linked to a government building.

EDIT: I'm not sure about hospital protocals but if someone had an actual heart attack they would be in a hospital gown. Not the same filthy BLM shirt that they came in with.

that doesn't mean he was there when he got arrested. idk, i would expect there'd have been a trespassing charge if he was inside. but who knows.

i do think him trying to steal some expensive tat he felt entitled to from mommy and daddy is the most likely scenario, esp when the theft charge is combined with harrassment charges.

So despite having been out of the house for almost a year (and having been formally banned from it), Dave continues to use it as his permanent address (i.e., never updated his license). I'm sure the judge will love that, but I'm also doubtful much of anything will happen: Dave will never acknowledge how much "white/class privilege" has shaped his life. I'm thinking plea deal, if anything, and that's assuming his parents are willing to see this through.

ETA: @Aunt Carol, it was never confirmed what kind of equipment Dave was hauling. I leaned towards meth, because it coincided with Dave's increasing nuttiness and skin-picking, but a lot of people suggested weed-related, more in line with Dave's public positions.

Out of his parents’ accounts? Highly unlikely - Dad is a co-sign on Dave’s account (or was), so they know he can’t be trusted with his own money, let alone theirs. They probably locked their credit cards away while he was softly ASMRing in their cellar like the freak hillbilly baby in Harold & Kumar.

I don’t know the actual legal arrangements on that account, but assume he can withdraw as needed, so that probably isn’t where the alleged crime occurred either. Mind you, the idea of Dave as criminal mastermind embezzler is pretty funny, given his general rat cunning retardation.

The speculation above re phone / guitar stuff / expensive tat seems more likely - it’s exactly the sort of stupid, low to no planning required, entitled stunt Dave would pull.

@monstrous bubo, to continue the speculation -- it was pointed out to me (thanks, @Catastrophes!) that he was charged with stealing, not robbery (link with info). This would suggest that whatever he (allegedly) stole wasn't taken from his parents' home, maybe a storage unit? Not giving up yet on my bad checks hypothesis, though.

I don’t think, based on that link, that there is any meaningful distinction between entering a home vs a storage unit and taking something - both places are premises that someone can lawfully exclude you from, so both enter and takes would be burglary. I think it’s more likely he picked up something in a public place, or private place he was invited into. That could cover shoplifting, but also Dad drops his iPhone and Dave picks it up with the requisite intention. Passing a bad cheque is however a different offence. Stealing Crimes

Stealing is the unauthorized appropriation of the personal property of another for the purpose of permanently depriving the owner thereof. Taking something that doesn’t belong to you… with no intention of returning it.

Money, credit cards, firearms, vehicles, controlled substances—regardless of the type of property, you can be charged for stealing.

Stealing crimes do not necessarily involve physically taking property from another person (robbery) or unauthorized entry onto a person’s property to commit a crime (burglary).

In fact, most stealing crimes do NOT involve robberies and burglaries. Shoplifting, for example, is the most common type of stealing crime, which usually involves neither a robbery nor a burglary.

That’s why, in Missouri, stealing is typically a misdemeanor, whereas robbery and burglary are always felonies. Stealing can, however, constitute a felony if additional circumstances can be proven.

Suppose it is determined that the amount stolen was $750 or more of the item stolen constituted “special property” like a firearm, credit card, or vehicle. In that case, it will be charged as a felony. (Even without the presence of burglary or robbery)

STEALING $750 OR MORE​

Stealing $750 or more is considered a Class D felony punishable by up to seven years in prison and fines of up to $10,000.

What Does it Mean to Pass a Bad Check?​

Passing a bad check is the term used to define a person who knowingly passes a bad or worthless check with the intent to defraud the recipient. What this means is that the person passing the bad check has the knowledge that he or she doesn’t have enough money in the bank account to cover the amount on the check and/or the check is written from a bank that he or she does not have an account or creates a check for a bank that doesn’t exist. Usually. If someone's being precious about it, the ED staff is just going to hike their shirt up and place the leads and deal with the psychosocial aspect later. Dave might have been whining about his gender-affirming unisex tee shirt or demanding that female staff be the ones to shave his chest hair for lead placement.

Thanks; he doesn't have the stereotypical body habitus, but he acts so meth-y that I wasn't sure if I was remembering right.

There are definitely fat tweakers, but he could just be a manic weasel through his natural mental dysfunction and thus come across as a meth user.

If all this is true, and I have no doubt it is, Dave is in a world of trouble.

ETA: The law refers to more than $750, but I see the complaint says he stole $1089.22.

ETA 2: The complaint also says Dave has shown up at restaurants where his parents go out to eat. They suspect he has access to their scheduling apps or something similar.

Ugh, incarceritis. Dave already has afib; that's why he has to grift for his "lifesaving heart surgery" (outpatient catheter ablation) so he'll be allowed to have HRT afterward. Maybe it's paroxysmal, or maybe he just complained of it, had the EKG at the jail confirm he was in afib (which he always is but shhh) and then he got some IV beta blockers at the ED.

Like any other landlord, the jail would rather not deal with Dave, so they are not going to be the most in-depth source for his medical treatment. This is sheriff to judge explaining something that happened in the hospital.

All this could have gone away if his parents had coughed up a grand, which is basically a rounding error with their wealth. Good on the Doctors Muscato for taking the nuclear option instead.

Class D felonies are punishable by up to seven years in prison, but if sentenced to less than a year Dave will be doing that in county. Either way, three hots and a cot would solve his housing and living expenses problems. Class E’s have a max of four years.

If convicted, Dave might only be fined. The max for Class D’s is a $10,000 fine These can however be charged as a misdemeanour, in which case the max fine is $500. There is also provision for disgorgement of his gains:

“If the person has gained money or property through the commission of the offense, to pay an amount, fixed by the court, not exceeding double the amount of the person's gain from the commission of the offense.”

That amount is deducted from the fine, so the overall penalty would be capped at ten grand.

The harassment offence he is charged with doesn’t have a misdemeanour alternative. The next step down is a civil infraction with no jail time, but cursory research suggests this does not exist for Class 1 harassment, so jail and/or a fine is the best Dave can expect if convicted.
