To put it another way if you generate/draw hardcore photorealistic violence, does that make it real? No. The same applies here. The State is trying to convince you (and so far is succeeding as we can see on a portion of kiwis) that "It was real in my mind" is a genuine argument for censorship and legislation. Except AI CP indistinguishable from the real thing without a watermark not only actively creates a market for real CP, but also makes it tremendously harder to prosecute real CP cases because of the onerous process that would be required to prove that the CP is real. Legalizing AI CP in any way, or even decriminalizing it, essentially decriminalizes real CP as well due to this. This also doesn't even consider how the set is trained (because contrary to popular belief it's perfectly possible to train a model to produce such things without using real CP as input, it's just harder), it's purely an argument about why producing a near-identical substitute to illegal material should not be legal. It's the same reason why you're probably still going to be slapped with charges if you try to sell a bag of flour as "cocaine" on the street and a cop catches you, though that example is fairly tangential to this since flour doesn't get you high.

Images of violence are not illegal, producing new images of violence is therefore not illegal regardless of if they are AI or not. Any human who could manually produce images of artificial CP that were indistinguishable from real CP would also be logically restricted the same way as real CP is. Your entire line of reasoning only works if your end goal is to legalize CP in general.

You don't know that a priori, and will never be able to determine if it's not real or not unless the images either have some sort of watermark indicating that they are AI, or you take a pedo's word for it. And while it may not be abuse, using the imagery of someone without their permission to generate content which can damage their reputation is to an extent illegal as well, that's called defamation at the very least. "Nobody should post pictures of themselves in any capacity" Do you have a job? Because if you do, there's a 90% chance that you have a Linkedin and they will almost always ask for you photo, so what you propose is an abject absurdity.
