Vogel, 44, was at his residence with a pair of females, aged 16 and 17. The prosecutor said it was discovered that Vogel had engaged in sexual intercourse with the 17-year-old and took a video of the incident. It was further alleged that the 16-year-old female, who had been drinking alcohol furnished by Vogel, started a fight in the home. Zink said Vogel took the girl’s cell phone briefly to keep her from calling the police.
Zink said the state does not believe that Vogel intended to engage in sex with an underage girl. Vogel himself said the girl had claimed to be 19 at the time of the incident.
Zink said the victim “knew what she was getting into” by trading sex with Vogel for alcohol and other benefits. “She was okay with that arrangement,” the prosecutor said.
Vogel took responsibility for his actions but repeated to Judge Fred Pepple that the girl had misrepresented her age.
“Yes, I did provide her with alcohol, but I totally believed she was 19,” the eight-year law enforcement veteran said.

As a Tier 2 sex offender he is required to register with local authorities every 180 days for the next 25 years.
