Being racist in and of itself is not a crime and a hate crime is not a crime in and of itself. A hate crime is something we tack onto a crime that is racially motivated. For instance if I kill a black guy and my motive was that I hate black people, that's a murder and a hate crime. The addition of the hate crime is meant to add on additional punishment.
