Heh probably, yeah. They own Zenimax and iD Software now though, don't they? I'm not sure I want iD revisiting Quake right now given how far away from Doom they've gotten with Doom Dark Ages or whatever the new one's called.
More people should just reboot the plot every game. Its why Nintendo franchises last 40 years while Sony franchises lose relevancy after 10.

What's funny about that is that it's a common instruction by many judges (to juries) to assume that deliberately misplaced or destroyed evidence should be assumed to be as damning as imaginable to the destroying party (e.g. if you destroy emails after you've been ordered to hand them over, the jury is supposed to assume those emails contained proof of your guilt). So by dragging their feet on producing it (and pretending to have lost it), they're making it worse.
 
Apple wouldn't lower themselves to produce a low-spec low-cost console, so they'd go the "boutique" route with a high-priced console with their "Apple silicon" SoC's and their famously nasty walled garden model. Online-only, of course (Apple ID/account required).
How Apple has handle Resident Evil titles, Death Stranding, and Apple Arcade makes me want to see them exit the gaming market, period.

Its entirely possible that they really did destroy it as part of normal operating procedure prior to the lawsuit. That is totally different than what you are citing, where someone, say, burns all of his papers after being called in for questioning.
 
I almost want to call bullshit on this (hard drives are cheap these days) but it's Bungie and they legitimately might be this incompetent.

The sad true is that it can be entirely possible that they lost or inadvertently erased this content. Game companies in general have a horrendous track record when it comes to preserving their own past creations. They don't see these as part of the company's legacy or history, these are just products that have a shelve life and once these games are no longer commercially viable they don't give two fucks about wasting space on a hard drive. let alone a vault or cloud service to safeguard these works to be preserved for future reference. They just didn't care to have new backups to prevent code stored in old hard drives that eventually failed and had to be thrown out.

SquareEnix losing the source code for Final Fantasy VIII / Parasite Eve and Sega losing Panzer Dragoon Saga's are just examples of how this is more common than one might expect. While malice can be attributed to in Bungie's particular case, that has to be proven otherwise there is really nothing that can be done about it. Instead as it has been mentioned such files have to be obtained from unsanctioned third party sources that did the "preservation" job.
