He's not wrong: the SCotUS doesn't have any sort of enforcement power, just power to set precedent for lower courts. The current "conservative" majority is way to political and optics based to make any tough decisions.

Any high school who paid attention in US history can look back at Andrew Jackson or FDR for great examples of Presidents who ignored or undermined the independence of the SCotUS when they wouldn't rule like they wanted. FDR may have failed to pack the court, but he got two justices to flip over this threats. Of course, Tim's a proud high school dropout, so this realization comes as a surprise.
