Wow, that came out fast. Just started reading and had to stop to mention footnote on Page 1:

"Perplexingly, the Defendants do not raise the issue that Kiwi Farms, as a website, is not a legal entity capable of being sued."

I mentioned that way back a few minutes after I stumbled across the lawsuit and brought it to the Farms' attention. How do you sue a website?? He needed to name the "corporate" entity behind the website. I am glad that was pointed out as I thought I was going nuts that they were entertaining his improper naming of a defendant and didn't turf at least the action against KF immediately. At least that has now been addressed.

Now, back to reading what I expect will be another great smackdown on Russ.

I’m not sure how sympathetic the Judge will be to a motion for costs. It may depend on how much Russ’s Supplemental Bullshit pissed her off. I don’t think she viewed his initial complaints to be made in bad faith. Just ignorant stupidity.

She does mention Russ's bad-fatih claims against Skordas though. Maybe that will contribute to her ruling.

That's what I was thinking. The second sup brief with Hitler photo probably made her pump this out quick to get Russ to take a hike.

Everything was dismissed. Everything. With Prejudice. I hope Mr. Skordas asks for 5K+. I am sure there are limits in costs awards as there are here in Canada (we use a tariff system to determine an appropriate costs award) and the amount would depend on how much work was performed, how far the case was advanced etc. I am going to "guess" that if Mr. Skordas seeks costs, $2.5K has a nice ring to it, isn't too high and would be a good burn on Russ. But I'd like to see him get much more.

But those comments in that decision about bad faith and allegations about Mr. Skordas, that was like a huge invitation to him to seek costs as this Judge appears willing to hurt Russ in the pocket.

And yeah, the "plight" comment! LOLOL I bet when she visited the Farms and read about old Russell she knew using that word would give us all a chuckle! Wonder if Russell will call the Judge fat, bias and say she has AIDS?

Great decision, totally annihilates Russell's case and arguments. Just over a year after filing his claim against Josh and the Farms, Russell gets another big L in his legal career. Maybe he will have better luck suing our new pal from the UK! LOL

So from my experience working with disabled young adults, I can say that Russ seems like the kind of potato who will eventually go through the motions of being violent, but will fold like an accordion at the slightest resistance from a target. I feel like Russ will eventually have a physical altercation IRL, but I think it will go very poorly for him.

She's been working on this for at least a few days. It's just happenstance that the timing is this perfect.

As far as fees go, I think she might be amenable to considering fees for the last motion Skordas filed because as she said it was highly improper and full of scurrilous things against Skordas.

Oh yeah, it is, but Russ is gonna see a grand conspiracy, mark my words. Bet his appeal will contain an accusation that the judge is on the KF payroll. I'd like to see him get pimp-slapped for that because he screams everytime someone makes a (truthful) accusation against him, but thinks nothing of defaming people he sees as his enemies.
