This is absolutely how it works. I have a relative who is a business owner, and he was audited. He ended up owing seven figures because of expenses he couldn't document/justify properly. If the IRS comes knocking, you're presumed guilty and it's on you to show otherwise.

Edit: If I remember correctly, he tried the whole explaining some personal use shit as an investment for a future business. They basically laughed at him.
What crime was your relative charged with and when will he be released?
 
Racheal Ray has a cooking show. If she practiced cooking a meal at home that was going to be showcased on the next day's show the ingredients are a business expense. Even if she and her husband ate it afterwards and something happened that prevented the next day's show from ever happening. Still a business expense. "I cook on TV for a living." "I play video games on Youtube for a living."

It's a grey area and the $$$ numbers would have to be astronomically high for the gov't to bother pursuing it and/or setting a new precedent that'll have unpredictable consequences for thousands of people.
I'm not sure that's necessarily true. I would guess once you start using words like "practice" or "research", it raises red flags and its pretty obvious what you're trying to do.

No business would ever pay any taxes ever if it was this easy to just call everything business expenses.
 
Late, but...my take on it is that it's he keeps in his back pocket for slow streams to go for:
"Wow, look, I got 25, now it's only 10 for the gunner glasses, we're getting ever closer to a hat guys, not to mention the ultimate reward; I'll put on a vest - all this achievable only through tips, sound good?"

Been noted before. Pretty sure "behind the scenes" is code for "friends and family". That way he bypasses the majority of fees and keeps more of the money. Which is definitely illegal as it's a business. Not sure how the legality relates to the person sending the money if they know they're helping Philip fuck over the system. Only way to check would be accessing his PayPal account. The right one.

Otherwise there's no reason to not use StreamLabs/Elements. It's anonymous to the point where you can enter any name you want.

Does anyone know binge drinkers or have experienced itself or just an expert on alcohol? Can we tell how much he is drinking a day? We know how MUCH he's BUYING, but it would be the next thing, to find out how much. That 4 pm drowsy clip is pretty suspicious I'd say. I know he doesn't enjoy games anymore but it could be something much more.
We don't have the reciepts for what was bought, it might be that he drinks less than expected and his beautiful and ever-loving sperg wife is living the high life and craves expensive wines to stay around...

I'm quite a heavy drinker, also a Swede so shit's stupidly expensive even if I only drink the cheap shit, I'd say - if there's a biker party or two happening as well; I'd guess I could spend 300-350$ in a month. (not every month, the more hardcore ones, on average I'd guess about 150$)
 
Maybe he can get Nick Rekieta to be his lawyer pro bono. Nick would be downing shots of whiskey while Phil would be downing shots of gin.

So by now Phil has devoured his IHOP door dash breakfast and drank at least a quarter bottle of gin.
Now his 320 lb wife who is still rapidly gaining weight is driving Phil and herself with extreme prejudice towards the Fred Meyer a half mile away. Phil is in the passenger seat, getting a quick burst of dopamine after doing some WWE pulls, but Phil is nervous, Khet said she was hungry, like really hungry, and Phil only brought in $100 in tips yesterday. He is going to have to not pull much today because BIG Khet needs the frozen lasagna.
Phil will start to feel better in a little bit when they go to the Sheri’s and Phil can devour another All American Brunch while he pulls more WWE Champions as he tries to ignore the sounds of grease and slop being guzzled by his 325+ lb wife, who is still hungry. Phil is looking forward to his slice of S’mores pie while Khet is excited for the rest of the pie Phil buys with the children’s money.
The day is only half over, and Phil will sigh and think to himself, if only those mouth drooling detractor trolls knew how difficult his life is. These trolls, who are just like the people who stormed the capital on January 6th, show him zero respect and cost him putting on a silly hat twice yesterday. His life has been tough, it has.

I'm not extremely familiar with Nick, but I'm pretty sure it's been confirmed that he's an accredited lawyer that's passed the bar exam.
Does he run an "extremely successful" law firm? Not likely, as he obviously has a lot of downtime to stream as often as he does, as you mentioned. Since being a lawyer isn't a typical job, it's had to say what constitutes being a "full time" lawyer.
I'm not sure how well he was doing financially before he started gaining popularity on Youtube, but the demographic of people he panders to sure seem to throw a lot of money at him, so even if his clients are few and far in between, he seems to be doing pretty well for himself.

Pretty sure he was relatively new in the field, and was just streaming once or twice a week for the fun of it, then he realized people would give him 20 dollars to answer their questions immediately and slowly phased out practicing law to drink whisky on stream and alt right click bait on youtube. Dudes got to be careful though, as time goes on no one's gonna care about the alcoholic who was a lawyer for a couple of years a decade ago.

He's just waiting for an order from fast food and horse feed from Petco.
