Rule 24 of appellate procedure should grant it automatically.

It's hilarious that Russ references and quotes FRE 401, because the second prong of the test for relevance is literally "(b) the fact is of consequence in determining the action."

Near faking his own suicide has nothing to do with any of the actions listed in his complaint. And even if it was somehow related, it would be excluded under FRE 403, because the probative value is far outweighed by the risk of unfair prejudice, confusing the issues and wasting time.
