It's funny to watch the mask of his already shakey legal theories fall off even more. If it wasn't obvious to the judge this whole thing was just Russ tard raging about being made fun of before, it should be blindingly obvious now. Null/Skordas don't have to respond to this do they? I hope Russ is now the judge's monkey to wrangle and the Farms doesn't have to shell out any more money to deal with Russell wailing "But the other kids are being MEEAAANN TO MEEEEE"

It might not change the meaning of the facts, but it absolutely changes your argument. The facts are that your shit is on this site. If you're arguing that Josh "allows" it, then you have no case. If you're arguing that he's "inducing" it, then that's a different argument and you might have a point.

But even that doesn't seem to be the problem here. The issue is that the judge doesn't see any inducement, no matter what you want to call it. It's not a matter of you not using the correct magic word, you impenetrable autist.

God, he's an idiot. He does this all the time with legal terms (and regular terms too, come to think of it). He repeats things he's heard people accuse him of, because those magic words worked for them so now they have to work for Russ. That's how law works, right? Duelling wizards or whatever?

He just needs the correct spell. He just needs to explain.

I've seen a lot of cows do this. Chantal and ALR are big on this too, actually. "It's not constructive criticism!" No one says people have to like you or treat you with kid gloves, or be gentle about breaking it to you that you're a disgusting hog who's eating herself to death. That doesn't mean it's invalid criticism, or that it violates YouTube's TOS or whatever. I can't imagine being so coddled and weak that you think anyone saying something in a tone you don't like -- even if it's entirely true and factual and not even that judgmental -- is grounds to dismiss them and comfort you. Russ kinda next-levels it when he says that Kiwi Farms is attacking other people as well, so he, Russ, must win his case and be comforted.

Id love to know who these "people close to him" are. He can't even allow replies on his social media or connect with humans online. But then again one polite interaction from a woman = "in a relationship with a model" so perhaps he once made the gym receptionist or a coworker his captive audience. Is it confirmed he has a therapist? Or maybe he's just named his trauma lumps and talks to them.

I couldn’t make it all the way through as the concentrated crazy was giving me a headache. But damn Russ, keep screeching about Skordas and the farms somehow killing people. I know it’s getting expensive for Null, and to have Skordas even respond to this is probably pointless. But I would so like to see a retaliatory filing that politely informs the Judge that the only “Vile” things being said in the Russel Greer thread, are us documenting Russel’s own public words and actions.

It’s absolutely not a real appeal. He’s trying to EXPLAIN to the original judge why she should change her ruling voluntarily. A real appeal is filed in the court of appeals and it’s purpose is to overturn a judges decision.

It's short of an appeal. It's meant to be for if the judge obviously fucked up and you're just pointing it out in the hopes that she will say "ah, fuck, I copy pasted the wrong thing there" and fix it. It's futile here as Russ is trying to re-litigate his case without actually filing an appeal.

I wonder if this is cheaper than filing an appeal? That might be why he's doing it in addition to thinking the judge is an idiot.

It's probably quicker and easier. I don't know if IFP status is automatically granted for an appeal in the 10th circuit if it was granted for the initial case.
 
Russel’s problem, we’ll one of them, is that he keeps treating the courts like they’re a teacher he’s tattling about a classmate too.

They were mean so they must be punished.

Until that really sinks into his little peanut brain, he’s still going to bring stupid lawsuits and cry to the judge about how unhappy he is. Like it matters to them. It doesn’t.

No judge on the planet can force people to stop being mean to Russ.

It's a motion. Skordas needs to file an opposition in 14 days. It's a bullshit motion, so it's unlikely that the judge would grant the relief even if Null didn't file a reply, but it's better to file and ask for fees. Russ' Rule 59 motion is so poorly written that it deserves Rule 11 sanctions. None of the statements he points to in his complaint would be considered "inducement" by any court, which is why the court correctly dismissed his complaint with prejudice.

Also, he failed to review the local rules, because he went over the page limits for this motion without certifying the word count. Not a big deal because he's Pro Se, but more shit for Skordas to point out in an opposition.

The amount of manipulative language in the conclusion alone is breathtaking. I had to go back and read it again to make sure I wasn't imagining Russ's whining. No, it's there. It's a bit more articulate than your average preteen, but the thrust of it is pure temper tantrum bullshit.

The Court admits plaintiff’s life has been made hard and difficult, due to Defendants’ site’s purpose of attracting the trolls, so it would only make sense for the court to allow Greer to amend his complaint to attempt to cure/clarify the third prong that Plaintiff strongly believes and has shown is in his Complaint, if the Court emphasizes with him.

This case implicates a matter of great public importance. A failure to reverse would result in "manifest injustice." The public importance is that the public and Plaintiff has suffered due to Defendants.
It's not fair. I suffered! And the public suffered! I've never really explained how the public suffered, but they did! That makes it a matter of public importance! I keep going on and on about my suffering though, because that's what's really important here. Just imagine my pain being transposed onto the public and you'll understand.

Normally protected by the CDA, Defendants opened themselves up to liability by contributory infringing on Greer’s copyrights. By not allowing Greer the chance to amend and cure the third prong by showing the inducement in his original Complaint, Defendants will continue to hound him and infringe on his works for the rest of his life.

They hurt me really badly by being mean to me and saying my music sucked, and I worked really hard to overcome that. Can't you see how hard I'm trying here? I'm a hero for getting over my pain enough to pursue this court case. I'm brave! I'm strong! No one else could have overcome this. I'm special! How can you not reward my efforts? I suffered more than anyone else in the world and yet I overcame that suffering to seek revenge. How can you deny me that revenge? It's not just morally wrong, it's legally wrong. You're making legal mistakes here by not giving me what I want. I'm sure that just by invoking that, you'll be intimidated into agreeing with me. It's like asking to speak to someone's manager when they won't give you a free refill on your coffee even though you're a customer and and awesome guy.
