With respect to Emmitt's affidavit:

I asked him whether he actually knows the women ("victim") he mentions in his affidavit. He says yes.
I then ask him WHY the woman mentioned in the affidavit doesn't enter a sworn affidavit herself. He more or less says he doesn't know.

So, like... yeah. Nobody has to disprove Emmitt here. It's more like HE is the claimant and should therefore realize that a lot of (completely reasonable) people are not gonna accept his story at face value. This is like one step above "I saw Vic consensually kiss somebody, and it made me feel uncomfortable."

I almost wanna say this runs afoul of the "best evidence rule," but that's not really what the best evidence rule is. Instead, I'll just simply say his testimony is NOT anywhere near as compelling as would be the testimony of the woman physically involved in what he claims he saw.

Also, there's the part about perjury because he claimed to know someone's state of mind.

I dunno about purjury, but if Emmitt got called to the stand, and were asked that question, it would be "Objection, your honor! Calls for speculation."

Even Chupp should sustain that one (presuming he gets the case back). If Emmitt answers before the objection is blurted out, it would be struck.

It's never appropriate for a lay witness to speculate as to the state of mind of somebody not themselves. You could maybe get away with a lot more in a pre-trial affidavit, but I don't think a jury would ever hear what Emmitt thinks about what Dayna was feeling or thinking.

I mean, her fallback position if this went south could be to say something like "I never said that..." or "Emmitt is exaggerating the situation...", or something along those lines. The court can't put her ass in a sling for something that EMMITT swore to. They can't really even argue she has an affirmative duty to intervene and correct Emmitt.

Again though, we really don't know her position on any of this. She could be using Emmitt as a meat shield, or Emmitt could just be completely full of shit. That's why I don't want to turn a critical eye to her yet. I really can't. We don't really know what her involvement is in all this.
