What gets me about this angle is why he didn't just submit his audition as a group act (something that's already allowed anyways).I’m no legal beagle, but I’m reasonably aware of ADA.
The deal with ADA is that you have to be allowed reasonable accommodations to perform a job to the same standards.
So Russell, essentially, is arguing that he needs a band. So he hired a band. He created his own accommodations. Whatever. Fine. He was allowed that and then declined. So that doesn’t automatically mean that his accommodations weren’t allowed. It’s really the opposite. He was never denied accommodations. He got exactly what every other contestant gets: consideration.
If anything, he had a better chance suing based on AGT not paying for the band or just reviewing the music as written. He could then say that it’s unfair that his talent (music writing) is having to be demonstrated because of his disability.
But bc HE HIRED his own band to make AGT more able to judge his talent, he’s not really able to prove that he wasn’t considered due to disability. Like, lots of folks don’t get to round two. Lots. Most aren’t disabled.

And I understand that 'talent' is a broad spectrum, but AGT is a performative talent show. Being able to write good (in Russell's mind) music isn't something people would pay/tune-in to watch. So once again, why not do a group act? You can be the composer/keyboardist and let your band mates do the rest. Now you can use your talents in a way that actually fits the format!
Of course, I know the answer: Russ's ego won't let him share the spotlight.

He sees his bandmates as fundamentally beneath him. Not only are they just accommodations for his audition, they're lowly session musicians. Remember, Russ sees no reason he has to start at the bottom -- like they did. He thought Taylor Swift was going to make him a star -- by singing his music. All of these people are just vessels for his brilliance. He wants to inspire people through them. I can't believe he thought being told "good job" meant he was on the show. Then again, he thought a like on his Facebook post meant a semi-famous woman was going to go out with him and fuck him too. The terms and conditions he agreed to said AGT can reject your application for any reason, and like was pointed out, there's no guarantee that your audition vid will even be looked at. They get far too many submissions to look at them all. Part of being on the show (or the music business at all) is luck, being at the right place at the right time. Russ expects people to just move him to the top of the pile because he's disabled. Shit, I know people more than disabled than him who refuse accommodations on general principles. I knew a guy in college with MS who finished a four year degree in three years because he was that determined. And he refused any accommodations. He'd be disgusted by Russ. And probably laugh at him too.I still can't get over his basic argument of "I put in effort, I'm disabled, and not being selected made me sad, therefore gibs money." I legitimately found myself laughing throughout the day when I thought about it.
What he should really be wearing is one of those white helmets with a chin strap certain people have to wear in public...I was referring more to the shape and color of his pale bald and clammy head.
