Binger's showing a video taken by some guy who keeps calling Kyle and others militia without the recorder even being there. He claims that it's supposed to show Kyle's state of mind. Some guy walking around calling people militia and editorializing is supposed to show Kyle's state of mind. It's so absolutely nuts.

The prosecution has an absolute fucking turd of a case, he is being forced to preform a three ring circus with a wiener dog and a donkey. Keep in mind he is an exceptionally good prosecutor and will actually be handling Zieminski (the guy who shot just before Rittenhouse) shortly after the Rittenhouse case, also in front of the same judge.

I believe but I am not a lawyer that the issue is that the video the prosecution is trying to show refers to Kyle and his buddies as a "militia" and they are trying to argue that it shows Kyle's state of mind. That and the fact that the person who took the video is not a witness and isn't testifying in the trial. I think the judge is saying that if the defense can't bring up Rosenbaum being a violent pedo, then the prosecution can't use this video's narration to paint Kyle as a violent milita member.

Edit: They took a break and yup even CourtTV is saying the judge is right and the video is hearsay. They're probably not going to be able to use the video as evidence.
