So far, the hard R has been the most entertaining part of the trial- the rest so far is boring hours of Binger fishing for nuggets he can use.

Binger is a total slimeball, but he's a clever and skilled prosecutor- he just has no real case so he has to try every dirty trick and cheat he can think of to get the jury on his side. Getting the court to play a video with a doctored title that puts the words "Kyle Rittenhouse" and "Miltia" on the screen together every time it's paused or has a mouse-over is well, scummy, but effective at putting that idea in front of the jury even if it isn't admissible. On day two he got a lot of BS like that through (like conspicuously managing to play clips of people calling team kyle a "militia" several times while scrolling through the various videos.

McGinnis testimony was much better for the defense than for Binger- not sure why he was even called as a prosecution witness. When Binger kept pressing him to answer a certain way, you could see the "fuck it" in McGinnis' eyes just before he came out and openly said RosenPedo was going for the gun.

Gravy Seal (I love that term!) from Meal Team Six (OMG, this makes me LOL)- was pretty much useless as a witness, almost nothing he said was relevant since he was too busy trying to decide between twinkies and Ho-Hos to see the critical events. The one thing he got out that was damaging to Binger's case was the part where RosenPedo threatened to murder everyone. Binger was grasping for "reckless endangerment" when he was asking about full metal jacket and overpenetration but it's a weak argument, especially considering that despite having military training, Gravy Seal is not a qualified firearms/use of force/ballistics expert. (why the fuck didn't richards object to that just to fuck with Binger?)

The twitter cop's testimony probably should've been thrown out since he was not present for any of the video footage, and can't make any statements that validate or lay foundation for them, and Binger only asked leading questions which are always objectionable- Richards could've objected to almost every question and at least forced Binger to rephrase them enough to give twittercop an opportunity to fuck up his pre-rehearsed-pre-coached answers.

Still, most of this stuff is all theater at this point- the real meat will come next week when we get to see Disarmed Gage describe the events where he fucked up so bad he got his arm vaporized by a teenager because he was too stupid to realize that attacking a kid carrying a gun who's already had to defend himself recently is a monumentally stupid idea, and he should consider himself lucky that he didn't get two to the body and one to the head like he deserved.

OK. I'm a little biased. But I think it's ok to delete a terminally stupid pedo and friends if they attack someone in a manner that deserves a darwin award.

Yeah, I think Richards needs to cede a lot of the court presence to Lex. He doesn't stutter, he's a lot smoother, and his cross is great. Richards can keep doing facts and briefs if he wants, but Lex presents to the jury much better. Sure we have a hard time hearing him, but the jury doesn't, so his microphone fails don't matter overall.

Is the old lady running the computer? They should have Kyle do it tbh
It's not even about WHO is running it, it's about how messy/slow that computer is that it can't function correctly during an important trial

as an IT person, it's fucking annoying the hell out of me that they didn't prepare that laptop in advance

I'm starting to wonder if the Prosecution can survive a motion to dismiss?
I'd expect a motion for a directed verdict at the close of the prosecution's case. That means the defense moves that the case be terminated immediately and the judge rule the defendant not guilty from the bench on the grounds that no reasonable jury could convict.

I don't think it will be granted.

It needs to be made at that point, though, so it can be renewed if the jury does come back with a guilty verdict, as a motion for judgment notwithstanding the verdict, in which the judge is asked to rule the defendant not guilty, despite the verdict, on the same grounds that no reasonable jury could have reached that verdict.

If the first isn't granted, it isn't likely the second will be, either, but it will be an appealable issue.

Just that it's a freaking laptop is annoying.

I’ve said this before but even them using Windows Media to display the videos where tenths of a second matter is so bizarre to me. At one point the pros was trying to play a video and quickly pause it at the point they want… like do they realize there’s programs that help with that?

There was an instance yesterday where they were showing a video using VLC. Guessing it was in a format WMP couldn't read or it was manually selected.

Technology hard. -beats with a club-

The pros is my definition of a blow hard. We might get to see him go blue in the cheeks one day.

A very cynical part of me thinks that Binger is tanking his own case in the hopes that the judge will grant a motion for directed verdict at the close of the state's case. That way, he can put the blame on the judge. The judge has already ruled against the prosecution on some evidentiary issues (and he was correct to do so, in my opinion), and the people who want to see Rittenhouse get convicted hate him for it. It's easier to blame the judge than it is to say the jury got it wrong.

Basically everything is going Kyle's way right now. The only thing that can doom him now is a politically motivated jury that has already made up its mind, and I don't think it's likely.
There's not nearly the impetus to convict as there was in the chauvin case. Plus the deceased in this case are way less sympathetic than Floyd was, and Rittenhouse is far more likable than chauvin. I give him decent odds of beating it.

Well that goes without saying. Laptops always under perform when compared to desktops.

I'm assuming they are using bluetooth for everything or some sort of wireless dongle from the laptop to the TV. Personally I would have just hardwired everything. I see wires hanging down, but they could just be the power chords.

I'm also of the belief that this trial wouldn't exist under Obama-era America. This trial was more than likely a snap decision to quell the blood thirst of the rioters and save the small town. It's all show and they want to prevent folks from out of state to come back and terrorize the town again. I hope we get to see the Girlfriend today.

I have missed all of today and am just catching up. How have things gone for Kyle so far, today? Any shocks?
