I don't believe that a crime should exist that punishes people more harshly than an existing crime does because of alleged motivation. However, he's going to have a hard time fighting this.

Apparently was during Hanukah week. The sign is completely and totally inoffensive (literally just "Happy Chanukah"). The Government will allege that Baked's intentions were to make Jews in the area afraid of conduct their religious festivities and they'll have a good case. In 2018/2019 there was the Pittsburg temple shooting, the LA Temple incident with the security guard, and a shooting in a San Diego temple. The government has a good case to say that Jews are already afraid to go to temple and when people actively deface their fucking cardboard signs that just say "Happy Chanukah" it serves no purpose other than to keep up intimidation.

A 1A argument is hard to go with because it's more about removing someone else's expression vs. creating your own.

I used to think the Baked tearing down the sign was a jerk move. But after the past couple of years of statues being torn down and in most cases charges are not being filed against the perpetrators in those crimes, why the fuck should I care about a $10 sign being torn down.

In any case, I think various prosecutors are playing a smart long game by allowing his easy convictions to be played out in court. By the time it comes to the January 6th charges, which I think are bogus, Baked will be too scared to challenge as the sentencing will bound to be harsh.

But Baked did this to himself. He did it for money attention and profit.

On the face of it, it’s absurd that a guy tearing down a sign is getting a hate crime charge when there are probably tens of thousands of similar incidents that never go to court. If this was happening to anybody else I would probably be outraged, but this scumbag spent a year harassing and bullying random people for money. The full weight of the law should come crashing down on this piece of shit.

They're also not going to step into minor state proceedings just to save a loser who, even if he is an asset (questionable), is not a very important one.
