I don't believe that a crime should exist that punishes people more harshly than an existing crime does because of alleged motivation. However, he's going to have a hard time fighting this.
Apparently was during Hanukah week. The sign is completely and totally inoffensive (literally just "Happy Chanukah"). The Government will allege that Baked's intentions were to make Jews in the area afraid of conduct their religious festivities and they'll have a good case. In 2018/2019 there was the
Pittsburg temple shooting, the
LA Temple incident with the security guard, and a
shooting in a San Diego temple. The government has a good case to say that Jews are already afraid to go to temple and when people actively deface their fucking cardboard signs that just say "Happy Chanukah" it serves no purpose other than to keep up intimidation.
A 1A argument is hard to go with because it's more about removing someone else's expression vs. creating your own.
