A. A person commits criminal damage by:

1. Recklessly defacing or damaging property of another person.

For some reason, there are two counts of it. One is listed as "M2" and the other "M3." My guess would be that this is misdemeanor 2 and misdemeanor 3. The statute says:

B. Criminal damage is punished as follows:

1. Criminal damage is a class 4 felony if the person recklessly damages property of another in an amount of ten thousand dollars or more.

2. Criminal damage is a class 4 felony if the person recklessly damages the property of a utility in an amount of five thousand dollars or more or if the person intentionally tampers with utility property and the damage causes an imminent safety hazard to any person.

3. Criminal damage is a class 5 felony if the person recklessly damages property of another in an amount of two thousand dollars or more but less than ten thousand dollars or if the damage is inflicted to promote, further or assist any criminal street gang or criminal syndicate with the intent to intimidate and the person is not subject to paragraph 1 or 2 of this subsection.

4. Criminal damage is a class 6 felony if the person recklessly damages property of another in an amount of one thousand dollars or more but less than two thousand dollars.

5. Criminal damage is a class 1 misdemeanor if the person recklessly damages property of another in an amount of more than two hundred fifty dollars but less than one thousand dollars.

6. In all other cases criminal damage is a class 2 misdemeanor.

C. For a violation of subsection A, paragraph 5 of this section, in determining the amount of damage to property, damages include reasonable labor costs of any kind, reasonable material costs of any kind and any reasonable costs that are attributed to equipment that is used to abate or repair the damage to the property.

It doesn't list any class 3 misdemeanor version of the crime. One possible explanation is that attempting to commit a class 2 misdemeanor is itself a class 3 misdemeanor, so it could be an alternate for him not actually having damaged the sign at all.

In any event:

Class 2 misdemeanors are a category of misdemeanor crimes in Arizona that carry up to 4 months of jail time and $750 in fines, although the fines can increase with surcharges. There may be probation and other penalties, as well, including collateral consequences, community service, and paying restitution.

A Class 3 misdemeanor is the least severe type of crime in Arizona, except for petty offenses. Convictions for these crimes carry up to 1 month in jail and $500 in fines. Judges can also impose up to 1 year of probation, as well as other penalties, like community service and restitution. There are also collateral consequences of a conviction.

There's nothing currently up indicating whether or not this actually is a "hate crime" or whether Baked is just invoking the specter of that to rile people up. We'll probably find out about that at the arraignment or before with the usual Phoenix New Times article about the nawtsee Baked's latest shenanigans.

I think when that prosecutor had to pore through all of Baked's insufferable videos, he saw this Chhhhhhanukah sign thing and sent it straight to Phoenix.

If Baked is lucky, this is the only one of his many other dumb crimes on video that he gets prosecuted for. Most of them are trivial bullshit but if they felt like it, they could probably shower him with at least a dozen more in other places.

I think even the people who view him as a grifter hate him for political reasons. Maybe not so much people like us. But the few hangers on of the alt-right probably do. If Baked was more serious about the cause they would probably forgive his stupid behavior.

Bare in mind that Mike from TRS was still defending Cantwell even after the feds charged him over the Bowl Patrol stuff. If there are people who can still be sympathetic to Cantwell after everything he did then I am sure there could be people who are sympathetic for Baked.
