I'm pretty sure the with or without prejudice is a civil only thing.
No, it's criminal too, because double jeopardy bars multiple prosecutions. The prosecution can dismiss a case any time prior to jeopardy attaching, which is generally when the jury is empaneled and the first witness sworn in. Before that happens, a dismissal is without prejudice and they can bring the case again (within the statute of limitations). After it happens, the prosecution can't just request a mulligan. If they dismiss it's with prejudice.

A directed verdict is a better request and is an outright acquittal, and it is also necessary to file such a motion in order to file a JNOV after an unfavorable verdict.

Why he fled?
The defense brought up the tweet/post of Grosskreutz's friend (Jacob in the video), who said that Grosskreutz's 'only regret is that he didn't shoot Kyle right away' and the guy who tweeted that yeeted himself out of the courtroom. The court subpoenaed him regarding the post, so he's presumably gonna have to testify about it some time later. He didn't actually resist arrest or anything, but I think he got spooked that he was gonna be forced to discuss the post and wanted to get out of the court ASAP.

I really struggle to imagine what it must be like to live with that reddit meme mindset. Seems so incredibly...dull. Accepting news wholesale and having mind made up without looking at anything, banning and shouting down any opposing views. r/news thread comments seem to have actually watched the trial clips and clicked that this looks absolutely terrible for the prosecution.
I mean they view history as one giant stage of progress. They unironically think their parents are dumber then them despite the fact that in the 1980s car guides used to come with Manual's on how to repair a vehicle now they come with warning stickers that say don't drink motor oil.

Guns and standing up against the status quo are s-s-s-s-scary and id feel more comfortable if this innocent man is in prison, please understand!
Unfortunately the "comfortable with people like that" poster represents the view of the Libtard. This one just admits it more candidly-if you aren't "for the cause" then you shouldn't be accorded any rights or privileges at all. You should be treated at best as a resident alien, and at worst as a potentially hostile element. Antifa and "cancel culture" simply apply this worldview actively and systematically.

Oh Gosh. That's gonna be so hard for the prosecution to evade. They should show that tweet on some sort of power slide for the jury, and ask Grosskreutz point blank "do you agree? Do you wish you had killed him sooner?"

Would be an absolute killer blow for the defense.

And I'd rather violent arsonist pedophile protestors also not be participating in society. Though not necessarily in jail.

Lmao "sole survivor" the propaganda is thick as fuck. You know who else survived? One hundred fucking percent of the people who didn't try to murder the dude.
None of these people have bothered to look at it themselves, they're all going off the headlines, which would have you believe Kyle sprinted from several states over armed with an Assault Rifle 15 and started spraying indiscriminately into a crowd of well-behaved unarmed peaceful protestors.

They're not gonna bring up Grosskreutz to testify again as far as I know, but no shit Jacob is gonna be able to lie/evade about it. The point is that the jury's gonna see the post and it's gonna be another piece of evidence for them to weigh about whether Grosskreutz was an innocent victim just trying to come and help. The jury (presumably) isn't completely stupid. They're gonna see that post and, like any reasonable person, factor it in as part of Grosskreutz's mindset regardless of what Jacob says.

On direct you generally don't ask a question you don't already know the answer to. The hint is in the name, he's meant to direct his witness into giving an account which is favourable to his case while glossing over any potential areas of weakness. Yet he seems to keep walking into answers that he does not want or did not know about. I should rewatch parts of this but this seems like a disaster of a case.
You never want to ask a question you don't know the answer to in court. Unless you do.

The presumption is that the witnesses you call are friendly to you and you have either volontiarly interviewed them or gotten a subpoena for a deposition and you'll know substantially what they'll say. The witnesses he's put on seem like he's talked to them for a couple minutes or not at all and he's figuring out what they're going to testify to along with the rest of us.

Dismissed WITH PREJUDICE iirc, otherwise they can. They could also drum up new charges but a full acquittal makes that extremely unlikely since they'd be based on the same crime he was found not guilty of (yes thank you @Iceland Heavy for confirming).

Just to make clear, a Not Guilty verdict is not the same as a verdict of Innocent, fyi. You really aren't found innocent in a criminal trial in the US, just that the state was unable to convict you of a crime beyond a reasonable doubt.

edit; sorry for edits cat is not well and demands extra attention
Once a jury is empanelled jeopardy has attached and only a mistrial or defense appeal can result in a new trial. Any dismissal once jeprody has attached is with prejudice.

Already asked. Gaige claims he never said that or told his ex-roommate that.

At that point when they drag the roommate onto the stand they can use him to impeach Grosskreutz. He can of course agree that Grosskreutz never said that to him, and he was telling lies for peepee points, but that wouldn't play well for a jury, either.

More delusions on the Raw Story comment section:
Lemme guess this is proof of white surpremacy even though they didn't read the case, watch the videos, nor understand context.
The most important question is:
How EPIC will Chunk Yogurt's meltdown be?
Well old Buffalo Butt is going to need his maple syrup and pancakes to cry himself into.
They're having to resort to absolute craziness, like this bullshit idea he went there intending to shoot people, which is based on absolutely nothing. If he was going to do that, why would he be standing in front of a business? Why wouldn't he just find an elevated position with some cover and plink off some motherfuckers then leave without being caught?

That theory presupposes that somehow some 17 year old knew antifa was so insane, so absolutely stupidly criminal, that they'd walk up to a guy with a gun and scream SHOOT ME NIGGER over and over again while grabbing at his gun, so that he could have a self-defense defense. Who would even know these "people" are such subhuman, idiot shit that they'd do that?
Its cognitive dissonance. For alot of these people they're millennials and alot of them were raised in the 80s-2000s culture of the GOP is evil/bad because the TV says so. Plus add in the bush years alot of them thought voting team red was the problem. But while alot of millenials grew up and began to realize that the Obama years were worse then 2 terms of bush years on civil liberties. For a large amount of them they never grew out of the early 2000s mindset. Now add in the fact that websites like Twitter and Reddit have become more or less left wing echo Chambers these people are pushing hormones on kids thinking they're honoring the person who suicides themselves in the 2000s for being a closeted queer.

The jury was present when it was pointed out that he bailed after being served with a subpoena. I'm sure that made a great first impression, and I'm also sure he's going to catch a bench warrant for no showing based on prior behavior. I thought I heard the defense lawyer tell the judge he's supposed to appear Wednesday.

I think it's gone past cognitive dissonance. They want to exterminate ruralite conservative whites. Their duplicity shows self-awareness, although not of a morally decent sort. They lie, rig, and coerce their way into everything. They have literally no other approach. They don't hesitate to do great evils like subject children to mass molestation for muh LGBT rights, and if confronted with that fact they just get mad at you.

This goes well past mere cognitive dissonance.

Theoretically depending on what Jacob says, the defense might be able to drag him back up onto the stand to ream him out further if anything new is revealed.
