Yeah I had some coworkers making snarky comments about him crying, such as being "fake" or "oh he feels bad now for killing those man". Honestly comes to show that the common person either hasn't experienced or consoled someone who goes through a ptsd/episode. It's a very ugly thing and paralyses a person. Especially taking someone's life (leave out the fact that they were terrible people) isn't an easy thing to forgive oneself and forget. Especially as a kid. A mistrial is because of some kind of fuckery, like a hung jury. In this specific case, the defense is accusing the state of gross prosecutorial conduct, and that their ratfuck conduct has impossibly compromised the case, for which the remedy is throwing the whole thing out. In this case, it would almost certainly be with prejudice, meaning the state can't put him on trial again.

I remember on Rackets' stream the panel taking about putting the directed verdict AND mistrial for gross prosecutorial misconduct on the same filing so the judge can read it all at once, if its allowed by WI rules of course.

The key for me is that it seemed almost like an unconscious reaction, ie a mental/emotional breakdown due to recall of extremely stressful events. I was chatting with someone who started talking about the trial by insisting that Kyle was crying "crocodile tears" and that he was a bitch. Me and someone else called him a retard and all of a sudden he was saying that actually he didn't care much about Kyle, he was just upset that conservatives were encouraging "vigilante justice". A lot of those people are just fucking chameleons. No solid beliefs or opinions, they're just mouthpieces.

They will bring it if only to preserve the argument for appeal. Appeals courts usually never overturn jury verdicts, unless there are serious procedural issues with the trial that the defense raises at trial before the verdict.

So we are definitely going to get a mistrial hearing at a minimum.
