If and thats a big if it gets called a brady violation in open court by Schroeder. One if not both da's are fucked in a case this big and public. Criminal charges are unlikely (accidentally sent the wrong file they will claim)

Odds of that are very low. Everyone seems to forget that Binger has done hundreds of cases with Schroeder. The judge isnt going to go thermonuclear on what are effectively coworkers unless theres history there we dont know about.

That said this is a pretty slam dunk appeal which the judge wont like unless the prosecutors can argue they sent it to kyles old attorney or something of that nature.
They'd have a tough time claiming they'd sent the wrong file because Kraus said "Our version is much better and clearer" so that means at the very least they knew about the issue but didn't bother correcting it, and given how pissed off Binger has made Schroeder he could chew his ass out. Schroeder just needs to bite the media bullet at this point and call a mistrial with Prejudice, because god forbid the optics on him having to overturn a guilty verdict, however unlikely that is at this point.
 
Besides the shit that happened with Kyle's cross and trying to witness tamper? This time it's because the Prosecution sent the drone video they're using for the Provocation charge to the Defense at 1/4th the quality they have it at, meaning they withheld evidence.
Makes me hope the judge yells at faggot and tubo in court again. Its fun times had by all.

So, do I understand situation correctly?
FBI was sitting on most likely 4k drone footage of the scene, then prosecution got a low res version of that, and in the middle of the trial defense got an even lower res version from them. Original footage was conveniently lost.
Then prosecution used garbage quality footage to produce bigfoot hocus pocus out of focus image to gaslight judge with it to manufacture provocation.
On the original footage you would most likely be able to clearly see Ziminski ambushing Kyle with a handgun, exonerating Kyle.

Question. Why isn't Binger hanging from the lamp post outside the courthouse?
 
Disbarment is the ultimate consequence of prosecutorial misconduct, but bringing actual charges against the prosecutor is difficult even in ideal circumstances. There’s a lot of leeway because “it’s a tough job with a big caseload, sometimes they make mistakes uguu~” But of course if you or I make a mistake in court, our ass is grass. It’s an unfair system that favors the state.
The real prize is on appeal. If the Judge has been threatening a mistrial throughout the actual case, then the appeal makes throwing out a guilty verdict so much more likely - especially in cases where evidence was withheld or falsely used.
There will be no prize, they'll make sure Rittenhouse goes to prison at the bare minimum. It doesn't matter if they have to beat the jury to death and drag their corpses out on puppet strings, the state will make it happen.

The idea you think I’d honestly believe that Rittenhouse is a terrorist says more about you than it does about me. I personally just think the Overton Window has shifted permanently and that the expectation that the jury cares as much about the 2nd Amendment and the right to self-defense as a bunch of political autists is a recipe for disappointment.

These people experienced the Kenosha riots first hand. They are fucking terrified of it happening again. They understand how dangerous these people are. That empathy for a teenage boy in the midst of that violence will do more to sway a jury than any second amendment and self defence instruction.

I actually disagree. This trial has been fertile ground for successful appeal. In that circumstance the question isn’t whether or not Kyle had a right to self defense or possess a gun or whatever, but whether or not the prosecution hid evidence that would have influenced the trial. And clearly they did.

Actual murderers have been set free for less.

But I do wonder if there is any procedure for threats to the jury. Like, if the jury came out and told the judge they were too afraid of being identified and attacked to reach a verdict, what would happen in that scenario? Has it ever happened before? I couldn't find anything.

They'd be thrown out of the Jury and replaced with an alternate member, if so many jurors admit they're too scared that there's less than 12 jurors left a mistrial gets declared.

I don't know what would happen if they admitted this, but they did talk about jury intimidation being fairly common on the Rekieta stream earlier today, and one of the lawyers shared a story about a jury requesting a police escort out the back entrance before they would hand over their verdict. It's just usually fear of the defendant/their family/gangs rather than a mob.

The stupidest part of that is that in Wisconsin, provocation ceases to matter if the party who did the provoking deescalates or retreats. So even if the fake picture were real, the fact that Kyle was in retreat, shouting "friendly! friendly! friendly!" would nullify the matter. The real question is whether the defense can or did instruct the jury to that effect. The fact that its taking the jury this long on something that is so legally cut and dry tells me that there's some cunt among them who thinks that Kyle is a murderterrorist because he had The Bad Kind of Gun, and for no other reason.
