It'd stay with the same judge. All he has to do is say "All my rules excluding evidence stands" and its out. For one, they knew the judge had already made it clear they weren't getting mistrial with prejudice, so they tried without prejudice. There's also the fact that the DA might drop it considering this trial has made their office look like the Ringling Bros Circus.
