Way too optimistic. Kyle would have to testify again and there's no telling if he'll not slip up and misspeak again. What if the prosecution keeps him up there for 2 days straight? It was already a nightmare to get on the seat once.

There's also the probability they might be able to get the Proud Boys shit and Kyle's previous fight and joke about shooting looters admitted and pound that endlessly.
It'd stay with the same judge. All he has to do is say "All my rules excluding evidence stands" and its out. The judge isn't a total cuck, he just desperately wants to shove off his handful of (severe) fuckups to the jury. No reason, at all, to think he'd reverse himself on those rulings you mention.
 
The problem is it doesn't even feel like the trial shifted against Kyle. It feels like watching someone being thrown home run pitches repeatedly and the batter just looking at his feet and yawning.
More like the pitcher is blatantly trying to beam the batter in the head, and the umpire keeps pretending they didn't see it.

no he would not, but his original testimony would be in the evidence.
 
If the Jury gets hung, especially by acquitting him on some killings but not others for some damn reason, the DA probably would rather just silently drop the whole case and hope everybody forgets the clown show we've been witnessing.

He wouldn’t have to testify again. He can if he wants to, but he still has his fifth amendment right.

No he wouldn't. His right to avoid that is reinstated on a retrial. And all the defense has to do is play the clips from the last trial.
 
For one, they knew the judge had already made it clear they weren't getting mistrial with prejudice, so they tried without prejudice. There's also the fact that the DA might drop it considering this trial has made their office look like the Ringling Bros Circus.

Yup. If the judge pulls a Chupp, the appeals court will absolutely step in. It's a Brady violation, they'll have to.
