Serious question, what the hell do you guys actually want the defense to -do- here? They cannot admit new evidence and are at the mercy of the judge. Said judge is absolutely hell-bent on not making a ruling and having it go to the jury.

What do you -think- they should -do-?
Pin down the prosecution for withholding evidence, going hard for a mistrial with prejudice, rather than ceding ground.
At worst, the judge will say no, but I think it's fair to say he's strongly considering a mistrial. They state's case is on the verge of collapse.

Fatboy's explanation for the altered video makes zero sense, but the judge doesn't know that with any certainty.
Granted, they couldn't pull out an expert out of thin air, but there's got to be some standardized process for courts to compare and verify files.

They've already called Binger a liar during closing arguments. Something I completely agree with, from a layman's perspective. If Binger wants the jury to believe his own "testimony", rather than the available evidence and witnesses, his credibility is a single point of failure for his whole strategy.

They know what's going on, but they have to make the argument. Richards doth protest to little.

This is exactly my field and area of expertise.

Kenosha is a lean blue city on its slowly waning days as its major sources of income have mostly dried out. It has a sizeable black population for Wisconsin, but largely it's a place that well-off blacks retired -to-. Politically, it has a very large contingent of older, more conservative democrats. It is largely considered the Blue Dog capital of the state.
 
I don't get it. When they don't ask for a mistrial, everybody calls the defense spineless. When they do ask for a mistrial, everybody calls the defense desperate.

I get you guys think they should be doing something, but legal action without a solid plan is even worse than inaction.
no, people are shitting on them because they're approaching it wrong. what they should be doing is making it abundantly clear how underhanded and illegally the prosecution has acted and demand a mistrial with prejudice followed by sanctions against the prosecution for blatant and intentional violations of the law.

That way you put the prosecution on the backfoot of explaining themselves and reframe the entire thing not as a political trial the judge is afraid to intervene in, to a blatant and intentional case of misconduct that the judge has to intervene in. It opens an entire new vector to just flat get all the charges dropped and also has the strength that it puts the prosecution on the defense.

But with that said, as insanely insidious and malicious the prosecution is and how they should be stoned for it, I think people getting mad is just cause jury is deliberating and they have nothing to do but sit and say what should happen

The standardized process is... well, more or less "trust me bro". You and I both wish we could rate that statement horrifying.

Blue dog as in working class democrats, the kind of reasonable leftist I described, then why haven't they switched red? Blue is bad news no matter how. If they stayed firm in sane territory I also think hung with strong innocent tilt.

Well, I'll be damned. If that's the quality of work to be expected in an average US court, it's a miracle they're getting anything done at all.

Kenosha voted Trump twice. They are registered as Democrats, but many have steadily either abandoned the left for voting or outright flipped but not changed their registration.

In terms of media sway, nah. Rittenhouse has seen consistently high support throughout Wisconsin, even in counties like Milwaukee. The media blaring at them now won't change a viewpoint they already made. Riots could possibly, but serious pressure there began too late. Once someone has made up their mind, aggressive pressure becomes a crapshoot on whether it will move their opinion... or entrench it. And with that basically becoming a statistical coinflip, 12 jurors almost ensures that so long as there was 2 people firmly pro-Rittenhouse, one of them just became an immovable object.

Not true on either count. The Firearm was in Kenosha the entire time, and the court ruled a few days ago Kyle had a legal right to possess it.
2. KR, as a minor, fatally shot two people, and non-fatally wounded a third.
Being a minor does not abrogate your right to self defense. It's ludicrous to argue otherwise. Are you saying if you, a 6 year old are being beaten to death by am abusive Step Father, but then manage to grab a pistol and shoot him dead are now guilty of murder solely because you are under the age of 18? It's a ridiculous argument.

It's not surprising we see this argument though. This is how the media has framed the narrative and narratives are way more powerful then the truth. They have successfully convinced people it's not allowed to carry a gun around, especially on a public street. And that doing so makes every action of the rioters with respect to Kyle justified. This is simply not true.

The truth is pretty simple. Kyle had a legal right to carry the gun, and he had a legal right to be on a public street. Neither can be construed as provocation. If someone attacks you for doing something you are lawfully entitled to be doing, the crime is with them, not you.

There is specifications for the -admission- of evidence, but when it comes to ensuring that the Prosecution and Defense have the same evidence, its largely the honor system supposedly backed by legal requirements to keep it the same.

Trump is always good. He is satan for the type of people that would convict Kyle. So Posobiec might be right after all. I just hope it turns out true. Core aspects of your democracy, of democracy itself, are on trial here, lets hope for the best. I love democracy and seeing it end in such a way would be heartbreaking. At least this trial made me more fervent in wanting to become an attorney.
