Someone pointed out, quite correctly, that this kind of instruction is not favored in Wisconsin, apparently one of three cheese-eating surrender states where this is the case. I still think the judge will try something like it if the jury insists on sticking their thumbs up their asses and not coming to a decision. He will just try to come up with an instruction that isn't the exact "Allen charge" but tries to do the same thing.
