im starting to see what gehenna's getting at i think. IF the rumors of the holdouts being afraid of reprisal is true, what if this is her taking the easy road out? get herself removed from the jury for whatever reason and leave it to those who remain.
 
Another possibility that just occurred to me, she's planning to make it all public with the instructions as proof.

She could just complain to the judge that she thinks she will be attacked if she votes one way or another. Easy.
 
They had all day to ask questions about the instructions. Someone is trying to prepare a grand speech for tomorrow. We have a hostage situation, somebody who doesn't need an income is going to keep every else there until they get their way. Unless someone outside of the judge can stop deliberations (since I don't see him doing it), Kyle is catching a lesser charge.
