I'll go a bit further in explaining it. To prosecute both of them they have to prove that they were willing participants. Proving this does not mean they have to prove the other party was or wasn't. That is why the incest charge is easier to bring than rape.

They can convict Chris by proving he was a willing participant. Barb's willingness has absolutely no bearing on this determination, so it doesn't need to be made at all. It is a lot easier to prove Chris' willingness than it is to prove Barb's, thus prosecuting Chris is a much lower hanging fruit.

If Barb does not want to assist in a rape charge, then a rape charge would be difficult (though not impossible). If they later charged Barb with incest, they would have to prove she was a willing participant, but she wouldn't have to prove that she was unwilling. The defense would just have to shoot down the proof that she was. The standard for acquittal is not proof, just reasonable doubt.

i.e. reasonable doubt about Barb's willingness is not proof that she was unwilling,

Mostly though, nobody wants to prosecute the decrepit old lady on death's door.

EDIT: Furthermore, proof that Chris was willing is not proof that Barb was willing. It's not even probable cause. While there is certainly enough probable cause in this case to prosecute Barb, Chris' incest charge without a rape charge is NOT that. Absence of proof for something does not prove the opposite.

Chris is not going to kill himself -- he seems fairly comfortable actually. As long as he doesn't run out of books or letters he'll be okay.

Also, those continuances are not without reason -- the judge would start denying them if they were. Generally you only get one "courtesy" continuance without having to justify it.
