To correct this absence, the Digital Justice Foundation is a committed advocate before courts and policymakers for the rights of individual creators and for the often-underappreciated public interest in their rights.

Beyond the copyright context, the DJF promotes and protects civil liberties, privacy rights and employee rights as they are affected by new technologies. For these reasons, the DJF and its attorneys have been at the forefront of emergent legal issues surrounding algorithmic discrimination and governmental adoption of new technologies to administer traditional government functions. The DJF is also exploring novel ways to harness the power of technology to expand access to law.

In an age of rapid technological development, entrenched interests often drown out individual voices and overshadow the development of individual rights. The DJF is committed to ensuring that technology and traditional rights develop hand-in-hand.

They have only 3 lawyers, two of which took on Russ' appeal.

This is shocking, mostly because it implies that Russell believes that a team of lawyers might have greater skills or capacity than he does. Hopefully his next filing makes clear that he is the brains of the operation and that the lawyers are just there to help tie up loose ends he doesn't have time for.

Are these lawyers lunatics? Do they see some legal angle we don't? Do they think that going up against the well known Killer Nazi Kiwi Orchards will make them look good? Or are they knowingly taking on an unwinnable battle while collecting payments from Russ?

All three of them have Stanford JDs, which would seem to indicate they wouldn't be clueless enough to take Russell's delusional ranting at face value.

Too early to say, I think. We'll have to see when they file something. That'd (the contents) should give us good indication whatever it is a publicity stunt or they are just incompatent. They might be trying something like what ACLU was doing back in the day (when they were less political and more focused on people's rights) as where'd they'd take a lot of cases just to try and give people a chance to win when they alleged constitutional violations. They were very focused at protecting people's rights. Maybe these guys are similarly motivated.

He never appealed the order denying him trial (doc 29).

Not necesserally. The court could find that the district court made some minor mistake, reverse said mistake, and still dismiss the suit without trial (althought that'd be a rarety) (for reasons such as lacking jurisdiction, mootness, ect.)

That being said, if he wins the appeal, this will likely go to the lower court trial.

While this is certainly a lol worthy moment, I don't think for a second Russell would waste his hard earned money cleaning a Walmart on something like lederhosen when he could just venmo a dollar to every euro girl he follows on instagram and LinkedIn (LMFAO) in the hopes that it would get him a date. Also a more likely scenario is Russ finally breaking and murdering someone in Europe than him getting lucky with a girl

Interestingly, none of them have a license to practice in the tenth circuit, where this appeal takes place.

You just efile an application and it's generally a pro forma process unless you have some kind of ethics issue going on, aren't in good standing, etc.

Oracle said Google's use of some code was not fair use, and Google said it was.
SCOTUS upheld the original judgement; The code was fair use.

Amicus Curiae in Alliance of Artists and Recor v. Denso International:
"AARC claimed that in-vehicle audio recording devices that copy music from CDs onto hard drives within the devices, allowing the music to be played back inside the vehicle even without the CDs, are “digital audio recording device” under the Act. 17 U.S.C. § 1001(3). Based on this USCA Case #18-7141 Document #1825918 Filed: 01/28/2020 Page 2 of 36 3 assertion, AARC alleged that the three suppliers of the devices (DENSO, Clarion, and Mitsubishi), along with the three automobile manufacturers that sold vehicles containing the recording devices (General Motors, Ford, and FCA) (collectively “Appellees”) had violated the Act by failing to pay royalties and adopt the required copying control technology with respect to the devices."
DJF wrote in support of the plaintiff's appeal. Appeal was rejected; Lower court decision in favour of Denso & al. was affirmed.

Amicus Curiae in Brammer v. Violent Hues
In support of Russell Brammer who wants the lower court judgement reversed.
The lower court had found via summary judgement that Violent Hues' use of Mr. Brammer's photograph (it was taken from Flikr) was fair use. I'm starting to see a pattern here. FDJ wants fair use construed more narrowly and is intervening at the appeal stage. The Fourth Circuit reversed the summary judgement and remanded it for trial.

Yet another fair use case. These guys never met a fair use they liked.
Appeals court upheld the original judgement of fair use.

Summary: This could get very expensive. If you were thinking of donating to Null's war chest, now would be a good time.

The fact these guys attended and graduated from Stanford (which is, on and off, the top ranked law school in the US and one of the top ranked in the world) is somewhat worrying. Skordas went to University of Utah (currently ranked 43rd in the US). Law schools are of course not a definitive indicator of how good a lawyer someone is, but being a Stanford alum probably gives these guys heaps of contacts and resources that lower ranked law schools may not have access to.
