That's not it though, the doctor DID inform the mother and it's in his notes, the argument was that he didn't stress the importance of them enough.
This is a large part of why people are very confused about the case and this ruling.

the judge is nuts. that's the ruling right there.
anyone could sue for this exact case if they're older than EPIC and win on the same merits- being old enough to have been born when doctors took written notes only.

most will say "advised about folic acid" and nothing more.

every single person in the UK would not exist if their mother had waited to start taking these pills before conceiving- the timing wouldn't be the same so they wouldn't exist. it would cover every single person whose mother said "what if I get pregnant" to their doctor at any time.

it's crazy as fuck.

Yeah the crux of the argument from my understanding is that the doctor didn't stress folic acid supplementation enough, which would have stopped her from trying to conceive until her folic acid test came back within the normal range (doing this is not standard practice, like, anywhere btw.)

What I really think happened is that mom has some political connections and pulled some strings. I don't see any other defensible reason for that ruling.

There's lots of munchie gold but my fav was someone claiming EDS is one of the most painful conditions known to medicine. It reminds me of CFS advocates saying CFS is worse than MS and cancer, which is a real thing they claim.

I'm confused about this, because the specific type of spinal dysraphism this woman supposedly has is not preventable with folic acid supplementation. The doctor could have tattooed "TAKE A PRENATAL VITAMIN" on the mother's forehead and it wouldn't have mattered. It's not genetic, either, so it isn't like her parents are carriers and the doctor missed it.

Am I just not understanding the frivolous lawsuit?

Every single one of those "allergic" symptoms are opioid side effects and complications. How did this person forget about anaphylaxis? Not to mention how many substances are in a poppy seed. If your allergy is to natural opiates and therefore extends to poppy seeds just say that. It doesn't work the other way around. The surgery thing is nonsense since they could plaster on a buprenorphine patch-- wait that's at least 25 times stronger than morphine. Who could have guessed where this was going?

Interestingly I did look this up and this article says that drug abusers are more likely to develop an allergy to opiates. Lol. What an exceptional way of trying to seek the stronger synthetic opioids.

This lawsuit came down to timing.

If the doctor had recommended additional folic acid supplementation, the mother would not have attempted to get pregnant that cycle and would have waited until the next, resulting in the disabled woman not existing.

The argument is that if the doctor had been more firm in his recommendation, the mother would have waited to conceive until she had been taking folate supplements for a while. The folate or the type of spinal bifida are ultimately irrelevant to the argument.

Because if she had taken the long way home and bought folic acid tablets, she wouldn't have had sex at this time of year, at this time of day, in this part of the country, localised entirely within her kitchen. So the genetic lottery would be rolling a completely different bloom of chromosomes and a completely genetically different individual would have been conceived. This hypothetical sibling, who we will call not-Evie, would not have the genes for lipomyelomeningocoele because it is so rare, and not-Evie would be a wonderfully healthy child until Mummy Toombes started playing Munchausen's-by-proxy with it. N.b. it is probably genetic just not researched much as it very rarely causes issues.

Don't worry about not getting it. Plenty of people can't make sense of it because it's so bonkers. When Caroline Toombes got told by the doctors that the LMM isn't related to folic acid she made this story up of holding off sex to see if she could still sue, which I explained in this post if you are interested.

Evie still hasn't posted to her social media or blog which is hilarious given she would never go more than three days without posting. She's too scared of the backlash, or perhaps in intensive care for playing with her potassium too much to try to show off to the court.

You missed the AFAB bit meaning born female, identifies as non-binary but because doctors only see a female in front of them they think it will be sooooooo painful and need sooooo many opiates because females are soooooo sensitive and medicine is sooooooo misogynistic

Hopeful Stripes AKA VSED girl claims the hospice company "isn't in network" but is going to keep her high, erm I mean give her all the pain meds she wants. She than is also talking about how her KAFOs (supposedly done 3 months before she "choose VSED) help her. People questioned why her insurance would pay for those if she is going on hospice and her answer is just that "when I ordered them I wasn't going to hospice".

Play stupid games, win stupid prizes. I am going to guess the next hospice company has an issue too.

That makes it even stupider than I originally thought. Just sue the doctor for not saying “Mercury’s in retrograde, wait until next time”. I’m disabled and it sucks sometimes but sometimes you just gotta accept that you were dealt a shitty hand. Saying “I should have done it differently” and blaming people when there wasn’t an obvious crime committed is pointless. The idea that there’s a legitimate legal argument for “well I’d have done it differently if I knew what would happen” is ridiculous.
 
What if we discovered the afterlife and aborted fetuses sued their moms for unlawful termination? This is just as outrageous to me. At least if you're going to make an argument like this, try having a type of spina bifida caused by lack of folic acid in early pregnancy or a horrible disease like what hotwheels has bc his retarded nugget mom decided to reproduce knowing her offspring would have a high chance of having that horrible disease.
