Yes, it's legal, but in practicality it's largely so that people in the 15-19 range can get their jollies on unmolested (hehe) by the law.
Case in point: I knew a banker who, in his early 40s, only had "girlfriends" who were broken goth 16-19 year olds raised by single moms. He'd start hanging around them even earlier. But even these teens broke up with him after a short while (because he's a loser and predator).
10 years later now, I still feel it'd be fine if someone broke his legs and I dare say, that's a pretty standard thought in Europe. It's technically legal, but everyone will look down on you as a pedo, so societal stigma is a strong deterrent.
This is how quite a few issues are treated - it's not criminalized, but you'll be shunned and abhorred, which suffices to keep (most) people from engaging in that sort of behavior. It's how the catholics used to keep abortions low, when they still held some sway (thank fuck that's over).
A lot of legal philosophy here stems from Kant's kategorical imperative - which is very focused on equality before the law and not having an innocent person punished (as in, rather 100 criminals go free than 1 innocent hang), which tends to favor more lenient guidelines. Works fine if there's somewhat strong societal cohesion around shared values.
I realize you have somehow gone off the rails enough to only think in absolutes, but the imbalance in development that comes with a significant age gap matters to most.
