But I think Null just sees nothing but sticker fights and people who think themselves as right wing exiles from every other website on the Internet and see that this is just a way to talk about their fantasies of eliminating TPTB without having to worry about the banhammer like /pol/ on steroids, while any other left wing person that isn’t a troll a la HHH is told to “fuck off back to Reddit and die”.
The legal issues, the stuff that makes the site so difficult to operate, come from the lolcow threads. The nuisance lawsuits and such.

The politisperging forums just draw the ire because it draws in waves of rejects from other platforms. Sometimes they were booted for very good reasons. There are the keyboard warriors from the other side as well. The inability to find and maintain moderation staff for that part of the forums, and we are just talking for basic housekeeping duties, is well noted. Lots of malcontents and bad actors making life hell behind the scenes.
 
So, IANAL, but, reading through GoFundMe's TOS. Their weasel word catch all certainly allows for them to cancel a campaign. But it does not allow for them to transfer money to "charities of their choice".

Which means the money needs to be refunded. In which case the only potential Plaintiff would be the truckers themselves.

However, since that is not the case, they've made everyone who gave money a potential Plaintiff. With the usual bag of tricks. Tortious interference, breach of contract, false representation etc. remember, they manually approved the campaign after a short pause.

The big one I see though is "Unjust Enrichment", and this one is the doozy. Because that cause is not for Go Fund Me itself. It's for any Charity that Go Fund Me gives the donated money too. They could be sued too, and even better GFMs TOS would not apply.

The TOS for Go Fund Me only applies to Go Fund Me and the contracting parties. The Donors, the Truckers and Go Fund Me. If a Charity, being an uninterested third party accepts money that is the subject of a contract dispute, this is text book Unjust Enrichment and they can be roped into any lawsuit involving that money.

The final kicker is even if GFM gets away the charities may not. Because the bad act is not the acquisition of the money itself. It's accepting the money knowing that AT THE TIME there was an on going dispute.

Agreed. This money is now STOLEN from each and every donor. GoFuckMe has no right to unilaterally decide on donating to ANY charity on the donor's behalf. Hoping the Trucker's lawyers are on top of this, and hoping criminal charges can be lodged as well.

This could clean GoFuckMe's clock but good.

As a fellow artist, I can sympathize with him. There have been times when I've made pro-globohomo art for furries, when I don't believe it myself. You can't really determine the artist's true beliefs from a single image about it.

But this is an editorial cartoon, so lol. You chose to draw it yourself, the idea coming from you. You could've easily put nuance into an editorial cartoon. Picture's worth a thousand words, after all. Pathetic. And even if you were commissioned for the image, perhaps by the writer of the article (don't know the original article it most likely accompanied so giving the benefit of the doubt), your pinned tweet could've said that, instead of this which I don't even see how it's him backpedalling.

Going to depend on the country of the donator. In America this might suffice, but honestly given how sketchy this sort of behavior is I think legal action is still plausible. In Europe and Canada, hell fucking no. They have very strong refund protections, you don't just get to do something else with the money your received on a whim.
 
It's worth pointing out that donators can request a refund. I suspect they are trying to provoke the protestors to anger so the authorities can use that anger as justification for removing them by force. I hope everyone stays calm and doesn't do anything stupid.

This is actually a dirty move that proves that they are trying to steal the money. There is nothing stopping them from issuing an automatic refund.

I think you skimmed by the other guy's comment about how most people won't donate to GiveSendGo since they haven't heard of it, but most people have heard of GoFundMe.

Just to add on, the reason Unjust Enrichment exists is, for example, two parties are going through a bitter divorce and part of the dispute is a million dollars in a shared bank account.

The man can't just then take that money and donate it to March of Dimes or some shit. It's the subject of dispute. If March of Dimes accepts the money they can be sued in turn to make them give it back. Even before the actual disposition of the money is determined.

To be fair though, the Charities can also just be sent a demand letter and told to put the money in an escrow account controlled by the lawyers as officers of the court. If GFM donates all the money it may actually make it easier to retrieve in the short term because I seriously doubt any Charity REALLY wants to get roped into what could be a very nasty political lawsuit.
