That is not correct. The Oakes Test relates to Section 1, not Section 33:

What you describe in terms of justification for prisons may be why the original signers put it there, but Section 1 has been used to justify all kinds of major infringements. Ex: Canadians purportedly have freedom of speech, according to Section 2(b), and yet Canadians can be sent to prison for thought crimes ("hate"-related). This is on the basis of what "can be demonstrably justified in a free and democratic society" according to Section 1, ie some politician went to a judge and proved that making certain speech illegal is "demonstrably justified in a free and democratic society," despite infringing on freedom of expression. This would be a Section 1 Oakes Test in action, and has nothing to do with the Notwithstanding Clause or Section 33.

Either way, none of the restrictions that have been implemented anywhere have been enacted via the Oakes test, rendering them unlawful. No new laws have been enacted, meaning the authority of the Notwithstanding Clause has not been used. Further, only the Federal Government or a "regional" Legislature may enact laws via the Notwithstanding Clause, rendering anything done by a municipality unlawful.

Everything has been done using "Public Health Orders" as a work-around to bypass the constitution.

The funny thing about those hate speech laws is that they don't pass the Oakes test, either. They're subsections of the Criminal Code of Canada and any time I have looked, neither those specific sections nor the entire act itself meet the standard that the law can only run for a maximum of five years. I understand the concept of automatic renewal clauses, but nothing like that is expressed in the Criminal Code either.

Addendum:
I would also like to point out that not even via the Notwithstanding Clause can the Government lawfully restrict mobility, whether moving about inside the country or entering or exiting.

That was so hard to watch. Just look at those blank stares of the crew too - some of the cops/RCMP have that same look. It's so funny how many of them play the victim too, "omg these convoy protesters keep attacking meeee". You just know these guys went back to their manager/boss/whatever and told them some crazy lady yelled at them for no reason.

The only way to not be a cuck and be for free speach is to also be pro discrimination. Because they did so well in recent history, they are the oppressor in the marxist interpretation.

Freedom is racist, certainly to them at least. The way I'd put it is reality discriminates. If people are left to discriminate for themselves, their immediate lives typically get better, because they know their local situation better than any desk ridden bureaucrat or sociology professor, but then we don't get the gay amerimutt space dystopia that maximizes control for the oligarchs.

I hate political terms, always shape shifting bullshit. But more or less the moneyed powers that survived the world wars always leverage grievance groups to break down and co-opt companies and other entities that refuse to play ball with their bullshit and they knew full well what they were doing as they imported enough cattle and had enough kids sexually traumatized to use race and mental illness instead of economic class. This is one of the primary reasons these moneyed powers are abjectly evil, because they seize power by creating more problems than they solve. Like a parasite.

I don't know if it was an outgrowth of the policy you're talking about, but there was a conscious decision to abandon the economic proletariat (because capitalism worked too well to sow serious discontent among the working class) for "cultural Marxism" and try to do the same thing with a coalition based on identity rather than class.

The modern communist movements are what happens when you literally attempt to recruit and organize all the most dysfunctional, unproductive, neurotic, mentally-ill members of societies.

We don't have to live in this false dichotomy of communism vs capitalism, you know. I'd like us to remember the absolute state capitalism was in in 2008 when they pulled this switch. I'd also like to suggest that capitalism is fundamentally tied, and even destined, to become communism, or rather a managerial state. Like governments will form in anarchy, monopolies will form in a free market, which over time turn in to oligarchs (the US government hardly even tried to prevent this from happening) which will then subsume the government. Communists, as they're called, and neocons for that matter, seem to exist to more or less direct this transformation in a way that protects international finance, and to keep people from collectively realizing they can get off this ride. I mean as Woopie Goldberg herself tried to tell us, WW2 wasn't about race, it was about international finance. It was about race only in so far as the territory of international finance happened to be occupied by particular sorts (though the Germans were using the opportunity to do a little eugenics too, but what you're taught in school would have you believe that was the primary motive).

I would say that it seems to be kind of a mixed bag. Some say that the very notion of "racism," as a pejorative form of something more neutral like nationalism or patriotism, was created by Trotsky in the Soviet Union for internal use. Anti-racism was and is a rejection of nationalism in favour of imperialism; to respect the broader empire rather than your own nation. And they were right to prioritize that: indeed, the Soviet Union collapsed when they could no longer control demands for national autonomy, and a bunch of the constituent republics opted to leave.

Your nation was largely made up of your ethnic group or race. There's a link between nationalism and race that commies properly brought into the lime light because it was so common people didn't think of it, but
as a based black guy once said" race of the spirit not race of the blood" is an option.

Under no grounds should a business be permitted to discriminate against an individual for any immutable reason - for the simple reason that its a near inevitability that as time goes on, and more power is consolidated in fewer firms, that they will abuse this power ceaselessly. Attempting to carve out exemptions and rules just encourages gamesmanship and political bullshit around definitions.

The internet has the power to turn anyone with enough braincells and motivation into a genuine polymath. I have learned musical instruments, how to build/fix things, how to pick locks, how to code, etc etc all for basically free from the internet. Yet somehow it's just used as a path to porn, vidya, hugboxes, and outrage fuel by most people today.

It boggles my mind how so many people aren't self sufficient, especially when outside of literal disability there is no excuse to not be a god damned renaissance man. I'll bet most of that trucker crowd has more real skills than anyone whining from their pod, both from their job and from using the internet as a tool and invaluable resource to get whatever shit they wanna do in their spare time done.
