The appeals court AGAIN decided UNPROMPTED to give Russ more time to file his brief. It's the THIRD time IN THE ROW. Next deadline is 03/11/2022

I’m amazed they haven’t dropped it like a hot brick after realising what Russ is really like. The emails between Russ and the sleazy lawyers must be a sight. All the diary wailing he wants included, he has to be more work than the case by far.
 
Why does the court keep giving Russ more time?
Good question. The first time is understandable as they forced him to go to mediation and waste valuable time. The second and third times I have no idea why the court gave to him, especially since he neither asked, nor gave any indication (that we know) that he (or his lawyers) would need more time

Arbitration won't happen. It's expensive and Russhole doesn't have money.

If the court dismisses this and orders it to arbitration, he'll appeal it as high as he can, and that'll be the end of it. JAMS won't actually open a case unless Russ ponies up the better part of two grand and I doubt Fremantle will be generous enough to offer to pay his half of it after he's put them through all this trouble.

Agreed that arbitration will not happen if Russhole has to pay for his half, because he is allergic to putting his money where his mouth is when it comes to his lolsuits. Russhole being Russhole, I'm sure he will assume the agreement for Fremantle/Marathon to pay his half of the arbitration fees is still on the table somehow. I regret we will not get to see the shitfit he will throw when he's informed this is not the case. What, just because he made that offer and then backpedaled from it at warp speed, saying he never meant it and was lying when he said it, those meanie Hollywood elites and their bullying lawyers are not going to be obligated to pay his way now? What the frick?! DISCRIMINASHUN! MUH PLIGHTS!

Sorry, but would you mind elucidating a bit for the non-lawyer types? By what process does a court issue time extensions? Do they regularly review their caseload and extend ongoing deadlines (or does a clerk)? Or has someone taken an interest in this case and made an effort to make a motion about it in particular?
 
Why does the court keep giving Russ more time?
These extensions are being filed by the Mediation Office under 10th Cir. R. 33.1, so there are two possible reasons:

1. The Court views this as something that can be mediated between the parties, so the Mediation Office is providing more time of its own accord so the parties can settle and get this off of the Court's docket.

2. The Court is completely swamped with other cases of greater importance, and has determined that delaying this appeal would not provide any prejudice to Shitlips.

It's probably both reasons. But it doesn't matter how much time Russ' new attorneys get, because the arguments that they can reasonably present are limited to the arguments he presented in the lower courts. Granted they will try to throw as much shit against the wall as they can, because the 10th Circuit could address the new arguments, but it's unlikely because these aren't pure issues of law that could be decided without further fact finding; issues of constitutional magnitude; highly persuasive arguments that would be a miscarriage of justice if they were not considered; and contrary to Rusty's beliefs, do not implicate matters of "great public moment." The best argument Rusty's attorneys have is that he inadvertently failed to make the arguments because he's a moron who represented himself, but that alone usually isn't enough for an appeals court to consider new arguments on appeal.
