Yes, sometimes lawyers will send C&D's merely as a matter of scaring people into compliance, just like people draw up DMCA requests for similar purposes, but they are also sent at a prelude to actual cases, as in Vic's case. They do not mean "nothing" and if you receive one, you should take it seriously and consult a lawyer. Especially if you believe it may have merit. Even responding to one is a costly matter because the recipient has to retain a lawyer to decide whether or not they should respond, whether or not it has merit, and how they should respond. This is no laughing matter, nor can it be brushed off.
