Preston Poulter et al v. Ali "Dean" Assaf et al (2021)

  • 🐕 I am attempting to get the site runnning as fast as possible. If you are experiencing slow page load times, please report it.
If Vikki doesn't pay, they will seize any property she owns and auction it. After that, Preston has the option to put her in jail, until she puts up bond. Bond is usually the amount of the judgment.
Yeah maybe but there are very strict procedural requirements on actually doing that. Lots of judgment debtors are more or less immune to collection.

That said and considering these particular defendants are goddamn idiots, they really need to get their shit together and respond in some coherent manner to this case.

The thing that I wonder about is she said no law clinic would help her. That doesn't seem congruent to me. At least most of them would give her some sort of consultation, wouldn't you think? Even if they wouldn't write pro bono motions, their job is to give legal advice to destitute people being sued. Legal advice that's definitely better than Spectre would give her.

@VIkkiVerse got into an argument with @Spectre_06 and revealed her financial situation
@Captain Manning provided the gist:

The site is being screwy with media & images, but I have the clip ready for local archive.
You know what? After spending three minutes jumping through this stream, I'm unironically on Peggy Poulters side. People this stupid deserve everything that comes to them.

How can you be completely flat broke, no job, no income, no possessions of value, living welfare check to welfare check, and still think that your time is best spent screeching about TOS violations of someone selling comic books on the Internet?

She's a new Melinda Scott.

Welfare should be abolished and people like this should do society a favour and starve to death in the street.

Short of representing her, they probably gave her the only legal advice anyone who isn't an idiot would give: get a lawyer.

Dean just did a livestream with Saggymelonz saying goodbye to Comicsgate, addressing his future plans, and explaining some things.

Here are the parts relevant to the lawsuit:

- Dean and Vikki are indeed splitsville. All three defendants apparently aren't on good terms with each other now.
- The $1,300 in GFM money Saggy raised for Dean's defense is indeed in Dean's possession (I know some people questioned this, even though I told them she likely didn't do anything wrong, but there you go).
- SPECIFICALLY RELEVANT TO THIS THREAD: Dean alleges that @Spectre_06 was lying on a recent EVS livestream when he claimed that Dean asked him delete the infamous posts in this very thread where he brags about writing Dean's legal briefs (and also humorously tries, again, to claim he didn't write anything before FROG actually showed the posts in question). He also touched on the fact that he wasn't happy with Spectre sharing DM's they had with Vikki to try and score points against Vikki.

@Spectre_06, why do you keep fucking Dean? Leave the kid alone, you crater-faced bitch. Clearly, he's got enough problems.

Before Spectre's admission here, he had already confessed on his YouTube channel when he livestreamed the reply brief before it had been filed with the court. So even if Dean did ask him to delete those posts, he left the livestream up for months.

Yeah, I know. I think you post is probably what spooked him more than anything.

I'm telling you, he wanted people to know he wrote Dean's motion right up until the point it didn't work, and Preston and others started dunking on him. Then, he didn't want people to know he wrote Dean's motion anymore. Amazing, isn't it?

I love the part of that clip where he name drops Rekieta and claims that Nick agrees with him. Judging by Nick's responses on Flashcast and elsewhere, I don't think he wants to any part of this idiocy. He's all but said Spectre is an idiot for interfering.

I dunno if @FROG has seen the above video clip, but that would have been a nice compliment to the KF posts you showed when you had him over the fire and were grilling him on this subject.

It's even worse than that, Spectre didn't even give credit to a fat Australian with sausage fingers who helped him write the legal document. Stolen Valour again. #JusticeForSmug

Well, the fact that it could open him to serious UPL charges might have something to do with this. Tbh the answer document itself has nothing staggeringly wrong with it, not that it's terribly difficult to write one of those. The problem was apparently filing an answer at all.

That's an entirely reasonable response to a lawsuit if you don't want to file a personal jurisdiction motion, such as against someone who will probably just file in your home jurisdiction anyway. However I seriously doubt there was much discussion on the lines of "you do realize if we file an answer you very probably can't file a personal jurisdiction motion?"

This is one of those cases where cheaping out is the most expensive thing you can do.

Anyway the new claim that they all appear to be agreed on is that Spectre did something that, had he done it, would possibly be legal or nothing you would be prosecuted for doing once unless the "client" himself complained. If he ever does get legally called out on it (like the pegged cuck trying to do something about it), he could just claim he didn't know the legal meaning of "drafted" and misspoke.

This makes that show with Peeg, Dean, and Spectre a whole lot funnier. Dean was taken off the hangout when his lawsuit came up, and then his secret, unofficial legal team commented as if they were ordinary observers. Peeg talks up Spectre as a special expert guest who can fill the audience in on the lawsuit, but according to Dean, he was more involved than Spectre was. Why does everything have to be a gay op?

They probably got a thrill out of Rekieta reviewing their legal work, which they then reported on as if they had nothing to do with it. And with Spectre having Rekieta's ear, you know he was trying to get him to cover their updates.

First of all, I don't think anything is going to happen on the UPL end. For precisely the reason you cite. Dean doesn't care. Discussing what could happen to Spectre is more of a mental exercise than a likelihood.

Secondly, I suppose it's possible Spectre lied again and grossly inflated in his involvement in all this. If that's true, it would spare him some or all of the UPL problems, but it still means he's a lying faggot. Again. Shit like this is exactly why he got halal'd and run out of here. Clout uber alles. Imagine being grilled on this by @FROG , and the best defense you can muster "I admit I was flexing a bit." Claiming to engage in UPL is a pretty big fucking flex. I also got the impression EVS and his panel didn't believe a word that was coming out of his mouth. I'm not sure I do, either. It comes down to whether Spectre was lying then, or lying now. Take your pick.

The two or three minutes from this that I've timestamped should really be clipped at some point. @FROG basically forces him to concede this isn't just autistic Kiwis lacking reading comprehension.

Thirdly, a point that was brought up early on, but got lost in the weeds since then, is that Preston could still depose Spectre, Smug Pug, or both and Dean wouldn't be able to claim attorney-client privilege. I think that actually has a greater risk of happening than Spectre getting nixed for UPL.

I can tell you that when I talked to Dean and Vikki I didn't WANT to know how the lawsuit was going from them, because I believed the best thing they could do was STFU and hire lawyers. All I did was give them moral support, and I tossed $20 into Dean's GFM. Anything more than that would have been asking for trouble.

This is one of those cases where cheaping out is the most expensive thing you can do.
This whole thing is going to end up being the poster child for how NOT to run a defense. It's just a sorry shame the Plaintiffs are Preston and Lamont.

I dunno, but oddly enough, Pug nuked his Discord after the Spectre vs. Vikki screaming match. There's some speculation it's because gay ops were emanating from there, and Pug finally realized he was in way over his head.

I was sent something a few of days ago that suggests that Pug's crew helped in trying to take down the Spectre thread on Dean's or Vikki's orders. I don't know if it's accurate (it has some issues, particularly with respect to identification of who is who on KF), but if it is, it would just show it's been one L after another for them since late October.

They probably got a thrill out of Rekieta reviewing their legal work, which they then reported on as if they had nothing to do with it. And with Spectre having Rekieta's ear, you know he was trying to get him to cover their updates.
I don't think any of them were particularly thrilled with how Rekieta was covering things after the Magistrate Judge recommended Dean not be dismissed. Or how anything went after January. This did not go anywhere near the way the thought it was gonna go. This is a dumpster fire.

Why does everything have to be a gay op?

It's fucking gay. Especially Spectres posts in this thread. They only learned their lesson recently when The Legion of Doom flagging Indiegogo TOS shit became too retardedly obvious for even Spectre. I swear Anti-ComicsGate is just 15 or so people (MAX) in the same discord server all posting on the farms as if they don't already know each other.

This episode of the Poz Show was a really good find. The part of it where Spectre is coping and telling Smug that it doesn't matter that they didn't motion to dismiss because Dean represented himself pro se so the courts will just dismiss his case because of jurisdiction anyway was hilarious given what we know now. I find the whole thing confusing, if you need someone with legal writing knowledge to format your motion to dismiss wouldn't they possess the requisite knowledge to know that it was filed in the wrong jurisdiction? Wouldn't they already have access to Ethans filing?

The part in Deans motion to dismiss where he starts arguing the merits of why Vikki shouldn't be sued was hilarious. Holy shit what are you doing nigger? This is your real life and it will cost real money. Clout from the people in the #ComicsGate thread has no monetary value. LOL

I hope it's the death penalty.

Spectre lied during this interview a fair bit. He said that people were going after Dean and Vikki to get to him. That isn't the case at all, I think Spectre is hilarious. He's very entertaining to read about. Spectre isn't malicious he's a pathological liar. Lying is a coping mechanism he developed as someone whose been unemployed ever since he got out of the military. He lies about his station in life, who he knows and his achievements with often hilarious results.

Since I know you read this, thank you for you service Spectre.

Nothing to see here, just sweep it under the rug. The timing of both Dean and Spectre blowing the whistle on Vikki.. it's purely coincidental.

My friend @Sriracha wrote an OP for a Dean and Vikki thread, I helped her a bit with it since scaling Mt. Autism without a sherpa carrying an oxygen tank is impossible. I felt bad for Stenographer, the janny because I kept coming in here and shitting this thread up but he has been pretty chill despite everything. Thank you for your service Stenographer.

Semper Fi.

Sorry @Yusuke, @VIkkiVerse and @Spectre_06. You'll have to log in to read it since it's in the Prospering Grounds.
