It's a near perfect example of yellow press journalism. Throw out a lot of rhetorical insults and denouncement of conspiracy theorists, then at the end of the piece admit that it's all true but claim the US defense department are funding pathogen research for entirely altruistic and humanitarian reasons. I take it from this, and similar, pieces in the MSM that the real situation is even worse than what we're guessing. The 3rd Geneva Convention states that combatants which pose no threat must be treated under the provisions allotted to prisoners of war.

The "no active part in the hostilities" includes the inability to relay intelligence to opposing forces. If you are forced to leave them behind, they can provide the enemy with intelligence. This argument has been used time and time again in cases where special forces were under no obligation to recognize an offer to surrender as valid. It also applies to instances of combatants attempting to surrender to planes and helicopters.
