In light of what we have seen with the current ongoing Chris incarcerated and probably institutionalized at the whim of the court saga, what if Chris had used his bat on someone rather than the pepper spray?
Chris’s physical prowess aside, let’s assume that this theoretical victim was unprepared, not convinced Chris would hit them, so this resulted in death or a coma.
Say it results in a serious charge like manslaughter/whatever the Virginia term for unintentional homicide, or assault with a lethal weapon, what would Chris’s situation be now?
Would the court, prosecutors and defense be as willing to have him mentally assessed as he is now, or will they be less likely to be bothered with all that shit and have him do hard time?
Defense can get assessment no matter what, at which point it's up to the doctors to make the determination (judge still has to concur, but judge usually defers to doctors).
