In his lolsuit against Farrah, Russ repeatedly points out that he never received confirmation from her that she’d agreed to go on a date with him, but since she also hadn’t said she wouldn’t, he assumed the date was on and told his friends he’d be taking her out.

I’ve no doubt that to Russ, his therapist saying “being rejected by AGT has clearly upset you” means “I insist you pursue legal action against Marathon.”
 
I hope Marathon does go for legal fees, even though he's pretty much broke, because it will help discourage both him from continuing to bother them, and it will hopefully discourage anyone else from trying to sue their way to stardom.
I realise this is hopelessly optimistic, but given Fremantle's clout in the media industry, I'd like to think they'll feed a story to mainstream news outlets once Russhole's litigation against AGT is squashed once and for all. By making an example of Russhole, it'd send a strong message to anyone else thinking of suing their way onto AGT or any other show in this genre.

Granted, the only news outlets that'd pick this up (and I used the term "news outlets" in its broadest possible sense) would be Daily Mail and TMZ. That said, I suspect the target audience for the message that Fremantle and Marathon want to put out there probably reads both these sites on a very regular basis.

He wouldn't spend his own money on therapy. He probably went on 7 Cups and some rando "therapist" in chat made the mistake of validating what he said.

If you knew your patient was a sexually obsessed stalker and encouraged his behavior, and then he went and harmed someone as a result of your malpractice, you might even be civilly liable for it.
In this case? Nothing given that neither party seem to care about discovery.
If Russhole doesn't cooperate, Fremantle will probably just file their own and note that. Or they can file separate plans if they want. Fremantle probably could just say their discovery plan is they plan to do no discovery at all. Also, a stay on discovery would moot the plan anyway so there's not much point putting much into it.

Think of it this way, Russhole has zero evidence of anything that could possibly weigh in his favor. Why would they force him to disclose a bunch of stuff? It's not like it could move the needle below zero. They might even accidentally force him to disclose something that it turns out hurts them, although that is a remote possibility.

So it really doesn't serve them at all to ask for discovery at this point, unless the standard required disclosures haven't been made yet.

I could easily see their entire joint discovery plan containing less original text than this post idly speculating about what it might contain.

The judge will berate both parties and do one of two things, either order them to get together and submit a joint discovery plan, or she'll just unilaterally set dates.

Edit because I'm retarded and forgot to clarify: If Rusty was represented by counsel, she could toss the whole thing out for failure to prosecute if he failed to submit the joint discovery plan and failed to show up at the scheduling conference. But he's appearing pro-se and it will usually be up to the party with an attorney to file the joint report in that case. So if it's not filed, she'll call them in for the scheduling conference, berate them, and have them go into the side room to work it out or she'll just set dates. Sanctions may be appropriate depending on how it was fucked up.

I wouldn't be surprised if someone in AGT's side is so tired of his shit at this point that has thought internally about letting him participate in front of the judges, not only to show everyone to make him a fool of himself on national TV but so the judges can expose his lawsuit, criticise his lack of talent and completely emasculate in such a way he won't be able to come out of his house without being recognized as "That guy who was humilliated on Live TV".

Granted they know it is a bigger headache that it is worth so they just probably prefer to keep this matter out of TV, but God, in their place I would be so, SO tempted.

The judge is reminding both parties that if either one wants discovery they should do something about it. Neither of the parties care. They just want the motion to compel arbitration dealt with.

Agreed, and actually think it would only serve to bring out even more retards to try the same thing. Some people just get off on attention, good or bad, and would do whatever it takes to get their 15 minutes.

tbh I wouldn't be surprised if most people involved with AGT's production don't even know who Russhole is, and may only have a vague idea of what's going on based on water cooler talk from when Russhole first filed his suit.

At best, there's probably a couple of big wigs and/or their PAs that are liaising with their legal counsel, but even then it's probably just emails from the lawyers letting Marathon/Fremantle know if anything major has happened wrt Russhole's legal action.

Said Marathon/Fremantle big wigs probably have far more important things to concern themselves with, especially given that there's a series of AGT in production rn.

Yeah, thinking it through you are completely right, drying his hooker fund is in fact as effective and won't validate Russ.
