A bribe, essentially. So he feels like he achieved a small victory and goes away and stays away. Of course, he won't go for it. He's made it clear he wants to audition in front of the judges (esp. Heidi) and nothing else will do. And Marathon has made it clear they will not let him on the show no matter what impotent threats he spews. There's nothing to discuss. Marathon had every right to reject him, they didn't violate the ADA or any other law, so the only thing the arbiter can do is rule in Marathon's favor, ban Russ from ever auditioning again, and have security drag him out of the building.


Pretty sure it's fairly low odds. I'm sure thousands of people audition every season. I can't find how many contestants start the season. But last season, 36 contestants made it to the quarterfinals, so it must be a lot of contestants to start with. Russ wouldn't make it past the first performance in front of the judges. And despite what he said in his filings about how if they just let him on and he gets voted off, he'll move on, we all know he wouldn't. Dealing with Russ is like negotiating with terrorists. Don't do it. You will only inspire more terror (or bad behavior). Marathon has held firm that he's not getting on the show for the precedent it would establish. Plus, Russ didn't think this through (shocker). Let's say Marathon caved and let him on the show. It would come out he sued to get on the show. Even if he somehow managed to advance to another round, that fact would be looming over him. If God himself intervened because he works in mysterious way and Russ won, everyone would think and say he sued his way into victory. It would be hollow. No one would take him seriously. And even if he did win, the prize is a Vegas residency. How would that work? He writes songs. He barely performs. People go to see the lead singer, they don't pay attention to the keyboard player. And songwriters don't get credit at concerts. Their reward is their payment. Russ has no idea how the entertainment industry works. He would not get the fame he craves even if he were good at writing songs.
So let's estimate the odds are 50 in, let's say, 50000 online auditions submitted. That's 1 in 1000, if I'm not wrong. Russell's chances to get in AGT are really slim, and having a disability does not guarantee his entrance (even when participants with a sad story tend to get golden buzzers in there). Man... Just get a job as a lyricist or as a pianist. Whoever is hiring you will get impressed with "you're like an enchilada, you add spice to life".

If he really wants to be a performer then he‘ll need to promote himself as a novelty act. A kind of Margarita Pracatan for the 2020s, but with none of the charm or talent. Or, given his songwriting, maybe a comedy performer, like an incel version John Shuttleworth.

Of course, he’d never be able to reconcile novelty/comedy status with his self-image as a cool, studly dude.

The thing is, he doesn't have a sad story. Sure, it's a hindrance that he can't close his mouth or move his eyes from side to side, but he can walk, see, hear (listening is an issue however) and take care of himself. His family, to the best evidence available supported him as best they could. He's not inspiring, especially not now after all the stupid shit he's pulled. He uses his disability as a crutch every chance he gets. He sure hasn't overcome it. He's not homeless nor has ever been. He hasn't really overcome any major obstacles. He's not inspiring at all (except in a negative way, maybe he's inspired people to turn their lives around so they don't end up like him).

That was also his excuse for using Bailey's (the girl who killed herself and he blamed us when he was the one harassing her) photograph in his book even though her family asked him not to. They also told him that her suicide had nothing to do with trolls or him and to leave her out of it. His response was it was fair use and there was no law saying he couldn't. For those new to the thread, Bailey was an Instagram model that Russ was harassing, and she told him she had a boyfriend. He demanded proof of said boyfriend, and accused her of lying. According to her family, she had severe depression and had just lost her mother. Something that happened in her life that didn't involve Russ drove her over the edge and she committed suicide. Russ, being in the Royal Family of the Kingdom of Assholes, tried to pin it on us.

I imagine if they present a carefully itemized list of what time they spent on this, all or almost all of it will be justified if fees shift. I am going to guess from their general approach that they are going to be more parsimonious than some firms would be about fees and bill significantly less than they might otherwise have done.

While I would love to see them stick it to him hard, even a reasonable, non-vindictive fees award will be devastating to Russhole.

Indeed. If anything, he's the one who's going to have to cough up money even to get this to an arbitration he will entirely lose, and this isn't just my cynicism about arbitration in general. He would lose a plenary hearing with briefs and witnesses and all the advantages of federal procedure as well.
I just don't see the point in bribing him to go away. They are about to destroy this man and probably make him pay for attorney's fees. That should get him to stop way more than just bribing him to go away

If he'd managed to find some bottom feeding lawyer in the entertainment field, which is to say, any lawyer in the entertainment field but at the level who'd take Russ as a client, they might possibly have been able to cobble together some collection of causes of action, however bogus, but enough to be a huge nuisance to defend, at least if they could cook up some non-patently-frivolous argument the arbitration agreement doesn't apply (I am personally not seeing one but these "people" can be creative). That combo would make a nuisance settlement at least possible.

There is no way they can really just cave in to this loon without inviting more of this bullshit in the future.

Money makes it seem like he had a point. And he will either do it again or just reject the money thinking he has a point and be even more persistent. They are going to win this case and destroy him. That's all they need to get him to go away
All the more reason if money were to exchange hands it comes from his pockets and not theirs.

If he wants to be up there with the big boys it's about time he started acting like a big boy.

Fortunately for Freemantle/Marathon, he's convinced he knows more about the law than actual lawyers and does everything pro se. I think the only reason he let the two copyright ambulance chasers represent him is because about the same time the judge dismissed his suit against Null, he filed his AGT suit and he prioritizes getting famous over getting revenge (for now) and he didn't have time to devote to explaining why it's illegal to make fun of him and to explain why he's owed a career in entertainment despite having no talent whatsoever.

So Greer tried to spur the court into action and Judge Nancy said "No, U" and now he's back where he was a week ago, sitting on his hands, with no idea when a decision is going to be made. He is completely powerless to do anything but watch time pass. He must be so upset.

He seems to think that as long as filming is going on, they can still fit him into the schedule. I don't watch the show, but is this even feasible? Can they bring in another act last minute, without taking a spot away from someone else?

Anyway, a couple questions for the legal Kiwis:

If the court grants the motion to compel arbitration (with dismissal)
Greer will appeal, but what could he gain? His complaint was very specific that he wanted to get on the celeb judging round for season 17. By the time he appeals, celeb judging will be over. The court can't go back in time and grant his wish. So what would the appeal be for? Could he roll his request forward to season 18?

If the court doesn't grant the motion to compel
IIRC Fremantle gets 2 weeks to respond to the request for preliminary injunction.
  • Does Greer then get a chance to respond?
  • And then Fremantle gets to respond to his response? How much time would they get?
  • Then another wait for the court to respond?
It just seems like with all those responses and counter responses, that could put them into May, and that would really be cutting it close. The original Accommodations might not be available for rehearsal, let alone the actual show. Especially since they'd have to go to Los Angeles for it. LA is only a quick flight away, but I'm guessing they'd have to be there for a full day, if not longer.

Oh, we all get you. I don't watch AGT or those kind of shows, but I've seen enough clips of American Idol and X Factor to already know the Simon Cowells have tried to hell, back, and sideways to tell some of these midwits to find another avenue:

* Tribute band
* Parties/Bar Mitzvahs
* Bars/small festivals/larger festivals
* Give lessons in voice/writing/instrumentals
* Work your way around backstage. Learn lighting/set design/costumes/security/booking/etc.

But, these people are like Russ. THEY NO GETTIT. I really want to be a fly on the wall with Freemantle and Marathon's people. "Just...what the hell does he want?" has more than likely sprang out of several mouths.
But don't worry: These people have seen it all. Like, every day. They already know. What the malformed squash REALLY wants, and needs YOU ALL to guess, is to put him on the show, and JETTISON him straight to the final few acts. Then JETTISON him again to stardom.
Stardom the likes of which Steve Daughtry or Kelly Clarkson, could only dream of. Just... gift him that record contract and FORCE everyone to let him "Explain" in music.

I hate saying that it's sad when Michelle FUCKING Shocked even gets this.

Theoretically the appellate court could do their decision fast. Anyway, the likely outcome, if he wins the appeals, would be that the district court lawsuit would be dismissed as moot. So, even if he wins the appeal, he still loses.

That brings up an interesting point. Let's say whoever makes those decisions at Marathon falls, gets a concussion, and then proceeds to smoke meth. In their altered state, they decide Russ is the best thing ever in the history of mammals, and declare him the winner of the season by fiat. So he gets the contract and the Vegas residency. Someone streams his single. They puncture their eardrums with a screwdriver, and with the screwdriver still jammed in their ear canal, they post on a music forum that this is the worst thing ever. Enough people stream it and share that poor unfortunate's opinion Word gets around. His album flops. His show is canceled after only a week because no one buys tickets. The record company declines to renew his contract. What's he gonna do? Sue the entire country for discrimination? Sue the goddamn universe itself for reality not being the way he wants it? He tries to dictate people's responses to him and gets pissed when they dare to have their own opinion. Look at the whole Taylor Swift thing. He had a very specific outcome he not only imagined, but expected, and went nuclear when reality dared to deviate from his whim.

EDIT: Like @Useful_Mistake said, even if he did appeal, the initial suit would be declared moot because by that time, season 17 would be over. He would have to come up with a new act, audition again, and unless the Almighty or an advanced alien race intervened and gave him talent, he would get rejected again. And then he could sue over THAT rejection. That's assuming Marathon just doesn't ban him from ever auditioning for any of their productions ever again. I think they will, because he's been such a pest. And anyway, he sued once. What would stop from auditioning over and over, getting rejected each time and suing? He's incapable of improving, because he doesn't think he needs to, so he'd never get accepted.
