He is spreading enemy propaganda, demonizing and demoralizing country that is under barbaric assault. He doesn't need to be a spy. At the time when Ukrainian soldiers are on the front lines risking their lives, when their civilians are getting shelled, murdered, raped and abducted, when their country is being destroyed - this guy is doing propaganda work for the enemy from within. He's technically been captured by his own side, anyway, so there's nobody to receive him. The best he can do is try and contact the Chilean embassy and see if they can't negotiate his release.
