surely you've got an example of a court ruling that twitter functions that way and is under the purview of some precedent

No historical comparison of Twitter (or social media in general) exists. If you speak in a public square, I can identify you. Even if you wear a fursuit, I know you're the one speaking. You cannot broadcast on most radio signals truly anonymously, or without facing severe punishment. Broadcast television involves both the need for someone who owns a channel to permit you to speak, and even applies restrictions on that owner's speech - and again, no way to do it anonymously. Forums boards are necessarily closed communities, as your ability to publish posts depends on your account being permitted to be created and further on a moderator not removing/altering the content.

There is no legal or historical equivalent to social media / twitter. If the state wants to declare it a 'public space,' it will most likely fall under the reach of things like the civil rights act and other laws which allow the government to restrict certain forms of speech. Even then, it will require specific, targeted regulation to declare it such, and the government will then have control over what is published on twitter.

Further, a motion picture house, theater, concert hall, sports arena, stadium, or other place of exhibition or entertainment is described as a "public accommodation" in the 1964 Civil Rights act, qualifying them as 'public' spaces for that purpose. Yet they can all throw you out if you break their rules of decorum - how does this square up? Because, like radio and broadcast television and so-on, they are not truly 'public' in the sense of being government-administrated, and they are both capable of imposing their own restrictions atop preexisting government restrictions anyways. The government cannot compel a theater to tolerate someone screaming niggerfaggot during a performance no more than it can compel twitch to tolerate someone spamming poggers during a stream.
 
I am not a fan of Musk by any means, but these big tech companies are comically evil. What the fuck constitues "hate speech"? The greedy fucks haven't given any sort of standard. I hope he tells them to fuck off and completely destroys their hopes and dreams. This wasn't a monkey paw, this was the only other decision to give us some semblance of hope besides nuking everything and starting over (end of days), or a compotent US president that breaks up big tech in the name of free speech (Hell freezes over and we get back "nice meme" reaction).

That's an incredibly weak defence if that's how he got off. He called him a pedophile because he's a white man living in Southeast Asia, the "joke" doesn't work without insinuating he's a sexpat by extension. It's like making a "joke" about a male elementary school teacher or football coach being a pedophile, in context it's an incredibly damaging accusation.
That's the law, in most civilised countries, and rightly so. People shouldn't be punished for mere jokes.

I have my own schizo theory (that sounds pretty believable to me but your mileage may vary) regarding Musk purchasing twitter and it is based on the very convenient timing of Tucker Carlson being unsuspended from twitter. But to lay out this theory I have to sperg about something entirely unrelated (on the surface) first.

Since this post is going to be involving a lot of politisperging allow me to preface that to many I would be considered a Right Wing Extremist and said categorization is not all that inaccurate.

1. The sperging that is on the surface unrelated to Elon buying twitter
I will state this bluntly, There is a concerted effort by Republicans at all levels of society to seize power and implement their will, permanently. This involves the capture or suppression/neutering of all Institutions, Elected Offices, Churches, Financial Markets, Courts etc etc. This effort is being lead by Religious zealots, Extremist Ideologues and right wing/general business interests and is finding massive success on both the State and Federal level. This movement's most powerful weapon besides their reserves of cash, political influence and literal weapons is their ability to influence and propagandize their followers and supporters through media both legacy and social. Look at Christopher Rufo, he has admitted in still public tweets that he was stirring up the CRT panic as part of the culture war and despite these tweets being public Media institutions are STILL parroting the narrative he inserted. This media is obviously has the power to make or break people, this is where Tucker Carlson, Musk and Twitter come in.

2. Musk, Twitter and Tucker
The day that the big announcement came Tucker was unsuspended from Twitter and posted two simple words "We're Back". Now according to what I have heard this was because Tucker voluntarily deleted a tweet calling Richard Levine a man, while I cannot confirm this seeing as how Musk does not officially have control yet it seems likely. That tweet (with the implication that Musk is the reason that the suspension was lifted) in addition to prominent RW figures showering praise on Musk, in my opinion this looks like an effort to endear Musk to right wingers, to make him a member of the team regardless of his actual political stances.

3. The potential reasons for this
Either Musk is onboard with the Movement potentially after being paid off with future guarantees behind the scenes or this is just The Movement piggy backing on a golden opportunity. You also have to remember that Musk is a Billionaire, and the Youth (which make up the resurgent American Left) are everyday more and more Anti-Billionaire, The Movement is extremely Pro=Billionaire.

I hope this is bait. The side that gets their president removed from social media isn't in complete control of media, it's literally the exact opposite. So if it's between left wing and right wing, the right wing just won one battle after losing a thousand and most territory still being left wing. Btw it's not between left wing and right wing, it's between people that are trying to see beyond obvious media lies and put in the work to research, and those that prefer to live in fantasy land and think they're informed because they watch a news program.

As for the thing about the buy.... the real problem is that people on the right feel vindicated and defend Musk even as he's making sure twitter enforces personal identification and authentication.

Remember, the real fun part in all this is the part where idiots actually seriously believe they can just start niggering and fagging up the place with all sorts of slurs while the tranny jannies know they have job security for the period before the new owner, Elon Musk, gave them.

Those people, by a loose definition people but legal people nonetheless, can more or less do what they like on their way out.

It really wasn't a joke, though. Musk was angry that he had stolen the spotlight from him so accused him of being a sexpat pedophile in a I'm-joking-but-also-not-really kind of way.
