The issue is whether marriage is a religious ceremony beyond the law. The problem is that the government also recognizes marriages in law and confers benefits as such that go beyond civil unions, which most same-sex couples were already allowed to do. But if we are conflating what the government recognizes as marriage and what religious institutions and communities recognize as marriage, you are going to get dilution of a concept that is a sacrament for Christians. It doesn't happen lightly. Churches were worried they would be held liable for refusing to officiate same-sex marriages. Christian business owners have been persecuted for only offering services to sacramental marriages. It was a government/church separation issue, and the government offering tax benefits and certain privileges to "married" couples basically forced the definition to become more elastic on equality grounds. That's how conservatives lost the argument. But I think most religious folks would have been fine with simply giving the same benefits to all civil unions and insisting that marriage has a religious component that the government shouldn't get to define exclusively.
They will probably try to argue it is constitutional because they are only labeling certain things as misinformation and not punishing anyone directly. But Facebook will use them as an "official" fact-checking source and throttle users, as they've already been doing, and Biden is hoping that will leave the government's hands clean. Elon telling them to fuck off, though, basically means this is all a pointless exercise. They can't punish social media companies en masse for not using their stupid disinformation source. It's private, and there's nothing they can do to force his hand. They will then start murmuring about Section 230, which will escalate into a fight they cannot win. Absolute lunatics. Keep doubling down.
