All signs point to the latter. Yesterday Russian diplomats complained about Ukraine backtracking on the peace terms again, negating most of the progress. They aren't even bothering to set up meetings anymore and just yell at each other over Skype.

Everyone in that factory can expect a kangaroo court and decade or more prison time if caught alive, especially if officially affiliated with the Azov Battalion, as well as probably having a bunch of true or fake war crimes tacked on for fun. If they're handed off to the DPR to face court for any of these true and honest war crimes comitted during the War in the Donbas, they can also expect to face the death penalty, since that's still a thing there. Same goes for any foreign volunteers.

This of course, implies that the Ukrainian government wouldn't attempt to negotiate their return, or at least their imprisonment under Ukrainian terms, when the war is over.
