Wisconsin school district has lodged a Title IX complaint against three middle school students for allegedly using the wrong pronouns while addressing another student.

Three Kiel Middle School students are being investigated for sexual assault in connection to the incident.



"I reived a phone call from the principal over at the elementary school, forewarning me; letting me know that I was going to be receiving an email with sexual harassment allegations against my son," Rosemary Rabidoux, one of the parents of the students being accused, told Fox 11.
"I immediately went into shock! I’m thinking, sexual harassment? That’s rape, that’s inappropriate touching, that’s incest," Rabidoux added. "What has my son done?"
Braden, Rabidoux’s 13-year-old son, is one of the three Kiel Middle School students accused of sexual harassment, an accusation that she disputes.

"(The investigating principal) said he’s being allegedly charged with sexual harassment for not using proper pronouns," said Rabidoux. "I thought it wasn’t real! I thought this has got to be a gag, a joke -- one has nothing to do with the other."
In a letter from Wisconsin Institute for Law & Liberty attorneys, who are defending the accused students, called the Title IX complaint "inappropriate," and urged the case to be "immediately dismissed."
"The mere use of biologically correct pronouns not only does not constitute sexual harassment under Title IX or the District’s own policy, it is also speech protected by the First Amendment," the May 12 letter to the school superintendent, counselor, and principal read.

"The District has also violated Title IX procedures and its own policy in its handling of the complaint. The District should promptly end the investigation, dismiss the complaints, and remove them from each of the boys’ records," the letter added.
The attorneys said that Title IX "certainly does not cover 2 using biologically correct pronouns simply because the District characterizes it as 'mispronouning,' which is the sole allegation in the one-page Title IX complaint."
"'Mispronouning' is also not sexual harassment under Title IX because gender identity is not included within the definition of sex within Title IX. In fact, the Department of Education is currently attempting to amend Title IX to add it," the letter added.
The letter said that a statement from the music teacher in which the conduct occurred described "other conduct" that doesn’t come "remotely close to sexual harassment."

The music teacher’s statement said that the class “expressed frustration with remembering pronouns," and described other events that would chalk up to being teasing and argument between the eight-graders, the letter stated.
"To be clear, this statement does not accurately or fully portray the incidents described—as you know, the student in question has teased the boys as much if not more, including calling them numerous names and yelling at them for not using 'they/them' pronouns, even when they were not talking to or about her—but even if everything in the music teacher’s statement were accurately characterized, it does not amount to the sort of 'severe, pervasive, and objectively offensive' conduct that crosses the line into sexual harassment," the letter stressed.

The attorneys stressed that if the alleged victim student had been teased, that requires addressing by school staff and administrators, but "none of this warrants accusations of sexual harassment and the serious reputational harm that comes with it."

They stressed that the district violated the students’ rights by not providing a detailed notice of allegations before the investigation began. Instead, the attorneys said that the district provided just a "generic letter" sent "one day before the interview." The Title IX complaint is reportedly dated to March 29, 2022, but "the music teacher’s statement includes events that occurred after that date," the letter stated.
"Thus, either the Title IX complaint is mis-dated or it was prepared before the author (Ms. Kautzer) would have seen the music teacher’s statement," it added.

Recently there has been a lot of discourse in the community about the Kiel Area School District and the upcoming School Board election.

There are some accusations and inaccuracies that we, the undersigned staff members of KASD, would like to address.


First, Critical Race Theory is an academic legal theory taught in higher education. We discuss diversity, both as part of the state-mandated Language Arts and Social Studies standards. We discuss tolerance and respect to maintain a school that is a safe and welcoming place for all of our students. Anyone can access the KASD standards on our website, which has been accessible to the public for many years.

Second, this School Board, along with Dr. Ebert, is one of the most transparent and communicative of any administration we have had. We may not always agree with their decisions, but we have always been welcomed by anyone on the administrative team or School Board to discuss our concerns. The board meetings are live streamed so everyone is able to easily listen and watch if they are unable to attend. The allegation of “lack of transparency” is stunningly inaccurate.

Third, it has been said that we are trying to “indoctrinate” kids. This couldn’t be further from the truth. Your children never have been taught to apologize for being who they are. We are teachers that simply want to teach. We want to connect with your kids because that’s good teaching, not because we have some hidden agenda. You know us—we are local, we are parents, our kids are your kids’ teammates. We are your kids’ teachers and coaches. We are your friends, your customers, your neighbors. We love your children and would never hurt them. To suggest otherwise is heartbreaking.


Fourth, we do not use pornographic materials in our classrooms. This is ludicrous and insulting.

Last, it has always been the goal of this School District and board to improve student performance. It is our life’s work to do so, and the current board has always supported student-centered initiatives. Schools succeed when educators, parents and communities work together. Divisive rhetoric at any level will only hurt our community and our kids.

Therefore, we respectfully request your cooperation as we strive for excellence in the Kiel Area Schools.

So let me get the cast of characters right. A Ms. Kautzer is "investigating" this. The school site describes her as a guidance counselor, not a principal. The principal is listed as Deb Sixel. There are three music teachers listed: Becky Windisch Marcus, Danielle Hogan, and Chloe Gorman. One of those three is the one who wrote some report being used against the boys.

Legion is also smarter than so many people these days. Might just be my own 'tism, but his talk about how the Geth heretics came to their conclusion always tickles me. Its amazing how so many people these days are incapable of thinking something so logical. That two people can look at something and draw different conclusions from it, and not have either of them necessarily be wrong.
 
It's times like this when I think those homeschool weirdos may have a point.
The 'homeschool weirdos' have been on point for years. Ignoring CRT, intersectional propaganda and marxist ideology in schools, standardized teaching has been the bane of western society for decades. There are no positives to having your kids in government public school unless you actually just do not have time to raise them. And if that's the case, do not have children.
 
Am I misreading the article or is everyone else? It looks like the teacher supported the students accused of sexual harassment. Maybe it's that guidance counselor/principal pushing the title IX complaint? Or maybe I'm functionally illiterate!
