The Email Caste NEEDS to put down the growing Populist Uprising from the Forgotten Caste. They tossed EVERYTHING into 2020, they have no more power they can use against the right, and the right was supposed to react in certain predictable (presuming that you have a correct mental model of rural America or conservatives, they don't) ways. A confrontation that the Uniparty and the GOPe could put down and cover in the press forever would suppress the Forgotten Caste and the Populists (MAGA) for, well, long enough. Beyond that, they NEEDED to bleed that energy out of the right before it gets put to more useful, or at least less controlled, uses.
To that end, Jan 6th was supposed to be it -- they had bombs planted, they had panic buttons removed from sacrificial lambs' offices, they had a bill condemning the violence submitted before the event, they had professional agitators (Epps and the BLM founder who was onsite with an CNN journalist who was an Antifa filmmaker) on site, they had everything ready. And then the worst they got was a guy cosplaying as the fucking Dragonborn doing an unapproved tour -- they even obeyed the fucking velvet ropes. And they FUCKED UP THE TIMING, because it happened before Trump even gave his speech.
Anyone who knows anything about Conservatives or Rural America knew better than to expect Antifa terrorist rioting from the right, even with them blatantly stealing an election. But the left has NEVER had a correct mental model of Rural America, Conservatives, or Trump. The cartoon supervillains that exist in their minds take precedence over everything else. I won't fedpost here, but, if the left is hoping for Antifa style riots from the right, they're going to WISH that's all they got if shit goes down. The left organizes sheep. The right uses lone wolves.
But they NEED this confrontation. They NEED to smack down the Populists and the Forgotten Caste (formerly known as "working class") before the Forgotten Caste realizes they have WAY more political power than the Email Caste. To wit: The Email Caste can write mean news articles and fuck with bank accounts. The Forgotten Caste can refuse to put out fires or deliver food. The Forgotten Caste wins, 100% of the time, if it comes to that. Which is why they are acting like Jan 6th WAS a violent lynching and terror bombing of our nation's capital, despite it, well, not being that.
Meanwhile, the right is slowly seething and plotting. Replacing local election officials. Primarying RINOs. Memeing the shit out of stuff -- Lets go Brandon and "I did that" stickers, which are constant reminders that the right has NOT been cowed into submission. The right is fighting back in the culture war for the first time in 40 years -- thanks GamerGate -- and whoops, it turns out the left has a huge pedophile problem and anyone not a crazy eyed radical marxist doesn't exactly like what they're seeing the left DO with the culture. Worse, the right is rejecting the "lose with dignity" shit, and refusing to be controlled opposition anymore.

Depending on the amount of funds the federal government withholds. If it's a small amount, it isn't coercive, and thus is okay. If it's a large amount, that would be coercive and thus unconstitutional under the standard the Court set

Sebelius is that the federal government cannot force states to join a federal program (in this case, Medicaid expansion), and if states choose not to do so, they do not get the funding appropriated for the program, but they cannot be denied funding they were already receiving (Obama administration tried to take away ALL federal funding for Medicaid from states that did not join the expansion). I'm sure the drafters of any law that would try to do this would remember NFIB v. Sebelius and make sure that only future appropriations, not recurring yearly appropriations for the states already granted, would be denied
- The spending must promote "the general welfare."
- The condition must be unambiguous.
- The condition should relate "to the federal interest in particular national projects or programs."
- The condition imposed on the states must not, in itself, be unconstitutional.
- The condition must not be coercive.
So this "if you don't pass a red flag law to our standards you don't get funding" thing would meet standards
1 (reducing gun violence promotes the general welfare)
2 (the condition is unambiguous)
3 (this could be iffy but passing a law to fund states' enforcement of red flag laws that meet a federal-set standard is a particular national program, and the condition relates to the federal interest in having a nationwide minimum uniform standard)
4 (red flag laws are at the moment constitutional, and the only way they would not be is if they were abused as part of a backdoor large scale confiscation scheme that denied people their second amendment rights unjustly)
And depending on the Congress and the executive being smart enough to make sure the financial penalty to non-compliant states is not onerous, it would pass the muster for 5 as well
